The history of Grandi Navi Veloci:

1992: Grandi Navi Veloci was born.

1999: Grandi Navi Veloci - unique at the time among Italian shipping companies - is listed on the stock exchange to finance the development of its fleet, the most modern and innovative in Europe.

2003: Grandi Navi Veloci lands in the Maghreb and inaugurates the Genoa - Tunis line.

2004: the Grimaldi family and the Private Equity funds managed by Permira reach an agreement for the further development of the company, thanks to the entry into the capital of Grandi Navi Veloci of Permira's 80% and the remaining 20% to Grimaldi Holding.

2006: the new shareholding structure is established; shortly before the end of the year, the new partners Investitori Associati, De Agostini, Charme and part of the management enter the capital of Grandi Navi Veloci.

2007: Grandi Navi Veloci is chosen as the Best Navigation Company by travel agents, who give it the Bit Tourism Award 2007. In June, Ariodante Valeri joined the company as General Manager.

2008: the Genoa - Barcelona - Tangier line is inaugurated, kick-starting connections with Morocco. The same year, an ad hoc service for pet owners was developed and offered to passengers on board the ships La Superba, La Suprema, Fantastic, Excellent and Majestic.

2009: the Grimaldi family definitively leaves the shareholding structure and management of Grandi Navi Veloci.
The shareholding structure is divided into Investitori Associati (67.1%), IDeA Co-Investment Fund (20.1%), Charme (9.2%), management (2.1%), other shareholders (1.5%).

2010: Roberto Martinoli takes over as CEO of Grandi Navi Veloci.

2011: on 2 May, the Extraordinary Shareholders' Meeting of Grandi Navi Veloci resolves on a reserved share capital increase in favour of Marinvest Srl, to which a shareholding equal to 50% of the share capital of Grandi Navi Veloci is allocated. Marinvest becomes part of the Grandi Navi Veloci shareholding structure through a capital increase against a mixed contribution of cash and three ships (SNAV Toscana, SNAV Lazio, SNAV Sardegna). The new shareholding structure is divided between Marinvest (50%), Investitori Associati (35%), IDeA (9.2%), Charme (4.6%) and other shareholders (1.2%).

2012: On 26 May, Grandi Navi Veloci inaugurated two new maritime connections between the French port of Sète and the Moroccan ports of Tangier and Nador.
On 2 August 2012, the Shareholders' Meeting of Grandi Navi Veloci resolved to increase the share capital by EUR 30 million; during the Shareholders' Meeting, the Board of Directors was also delegated the power to carry out a possible subsequent increase up to EUR 20 million. The Company is therefore owned by Marinvest (50%), Investitori Associati (43.40%), IDeA Co-Investment Fund (3.66%), Charme (1.83%), and other shareholders (1.11%).
On 20 December, Roberto Martinoli was appointed Chairman of the Company; Giovanni Battista Vacchi joined the Board as Managing Director.

11 December 2013 a share capital increase to € 169,999,988.97 was approved. The shareholdings of the reference shareholders are split between Marinvest S.r.l.: (57.39%), Investitori Associati: (36.97%), Idea Capital Funds s.g.r. S.p.a (3.12%), Charme Investment S.C.A. (1.56%) and others (0.96%).

GENERAL CONDITIONS FOR THE CARRIAGE OF PASSENGERS, THEIR LUGGAGE AND ACCOMPANYING VEHICLES.The purchase of a ticket implies the Passenger's unconditional acceptance for all legal purposes of the following General Conditions of Carriage of Passengers (GTCP).DEFINITIONS:The term “Passenger” means any person carried on the basis of a ticket issued by the carrier and/or authorised agencies.The term “carrier” and/or “Company” means Grandi Navi Veloci S.p.A.“Subject matter” of the contract is the carriage service as governed by articles 396 et seq. of the Italian Navigation Code. The carrier undertakes to transport the passenger and the accompanying vehicle under the following conditions, which the passenger undertakes to examine and observe in full before purchasing and/or booking the ticket.The maritime transport service refers to the route indicated on the ticket including accommodation on board and any accompanying vehicle.Any additional services provided by the maritime carrier do not form part of the contract.The term “maritime carrier” means the contracting carrier and the actual carrier. The ship used for the carriage may be part of the GNV fleet or of another actual carrier.“Disabled Passenger” or “Passenger with Reduced Mobility” is any passenger whose mobility when using a means of transport is reduced as a result of a physical (sensory or motor) mental or psychological disability, impairment, or any other cause of disability or impairment, whether permanent or temporary, whose condition requires special assistance and the adaptation of services to passengers on the ship as a consequence of such disability.Art. 1 VALIDITY: the ticket is personal, non-transferable and valid only for the carriage specified therein. The Passenger is obliged to diligently guard the contract/ticket to justify his right to travel and to show it to any Ship's Officer or Company official who requests it. A Passenger without a ticket must notify the Master and/or Purser immediately. Failing this, he/she will be required to pay double the price of the passage to the port of destination, without prejudice, however, to compensation for damages.Art. 2 PRICE: the price indicated on the ticket is that of the carrier's tariff in force on the date of its issue. The fare is not fixed and is subject to decrease or increase. Special discounts and reductions have no retroactive effect on already issued tickets. Native/resident fares are not available on all departures and accommodations. Quotations do not confirm the price and do not guarantee seats on the ship. Taxes and fees for embarkation and disembarkation, stamp duty, etc., where due, as summarised on the ticket, are the responsibility of the Passenger. The ticket price is inclusive of taxes and port fees that the Company pays to each competent Authority according to the procedures established by them and that may vary from year to year.For Passengers bound for Tunisia only, in compliance with the Tunisian Law provision TUN n°2016-78 of 17/12/2016, the payment of the Passenger Disembarkation Additional Tax is due for the Amount of twenty (20) Dinars (or the equivalent in Euros on the date of payment).Said tax shall be paid at check-in; the GNV Maritime Carrier shall remit the amounts due directly to the Tunisian Treasury2.1 If the Passenger buys their ticket through the “PURCHASE ON LINE” web channel, the contract of carriage will only be deemed to be finalised once the booking system has communicated the booking reference number and ticket number (failure to receive the Internet Ticket does not affect the issue of the ticket already confirmed on the screen).2.2 Unless otherwise specified, the price indicated on the Ticket does not include the provision of food on board, which remains the responsibility of the Passenger. Prepaid meal packages (at a special rate) and only for group customers of at least 12 persons, can be purchased when booking the ticket. The type and composition of the package varies depending on the line and ship operation.It is also possible to purchase a voucher of different denominations (food pass) at a discounted rate that allows consumption at onboard catering outlets:when booking the ticket at port ticket offices at the on-board reception prior to the ship's departure. For any cancellations and/or cancellations, please refer to Article 6 of the General Conditions of Passenger Transport (GTCT) in force.2.3 In the event of a booking and issue of a ticket by a Passenger who needs to receive an electronic invoice in the name of a Public Administration entity, the Passenger is obliged to request at the time of booking the issue of an electronic invoice indicating the details of the entity in whose name the invoice is to be issued, such as (i) name, (ii) Tax code/VAT number, (iii) IPA Code, (iv) Tender Identification Code (CIG), (v) Unique Project Code (CUP), (vi) indication of whether or not the invoice is a “split payment” invoice and (vii) indication of the PEC e-mail address. For electronic invoicing to the P.A. the Passenger Assistance Service is available from the Groups Office tel. +39 010 2094591.2.3.1 For the Passenger who needs to receive an electronic invoice for the ticket to be purchased, the service is available by accessing the dedicated page of the website www.gnv.it ’request invoice“. In the absence of the aforementioned communication, the Maritime Carrier shall not be able to provide electronic invoicing and shall not be liable for any claim whatsoever.2.3.2 The request to issue an invoice for individual passenger tickets must be made by filling out the online form on the website www.gnv.it within the fourth (4th) day from the date of ticket issueThe request must be made for each new ticket replacing the previous one. A single monthly summary invoice (and/or possible credit note) will be issued. Following this request, GNV will issue an invoice in accordance with Article 21, paragraph 4 of Presidential Decree 633/1972, sending it exclusively by e-mail to the address indicated on the form completed in the aforementioned form. For all dossiers issued by the GNV Groups office, a monthly summary invoice will be issued using the data provided when the dossier was opened. Please pay the utmost attention to the compilation of the compulsory data requested; in the event that they should turn out to be even partially incorrect, it will not be possible to proceed with the request to issue the invoice.2.3.3. Invoices for catering and shops can be requested and issued directly on board at the front desk of the ship's purser's office.Art. 3. ACCOMMODATION: The Passenger will occupy the seat indicated on the ticket and if not available the one indicated to him by the Captain or the Purser. The Company, in case of objective necessity, has the right to assign the Passenger to a different seat. In the event that the seat assigned is of a higher type, no difference in fare will be requested, whereas if the new seat is of a lower type, the Passenger will be paid the difference paid in excess, without prejudice to the Passenger's right to terminate the contract in accordance with the law, by accessing the dedicated section https://www.gnv.it/it/assistenza/contatti/segnalazioni.3.1 Accommodations (cabins and seats) must be vacated in advance of the ship's arrival time to allow disembarkation operations to take place safely.The procedures and times for the release of accommodations, as well as the indications of the meeting points in the common areas, shall be announced by the Ship's Command.3.2 If Passengers with reduced mobility need a special cabin for the disabled, they must promptly inform the Company, which, in order to guarantee comfort and safety for the Disabled Passenger and the Passenger with Reduced Mobility for the entire duration of the trip, will have to assess the actual availability of the same, since such accommodations are, in fact, available in a limited number. Disabled Passengers and Passengers with Reduced Mobility may book a special disabled cabin by calling +39 010/20 94 591. More information is available in the dedicated area on the www.gnv.it website.Art.4 PRESENTATION FOR BOARDING: (i) domestic and EU journeys - the established check-in time is within two hours before the scheduled departure time of the ship for Passengers with accompanied vehicles, while for Passengers without accompanied vehicles it is one hour; (ii) non-Schengen journeys - the established check-in time is within four hours before the scheduled departure time of the ship for Passengers with and without accompanied vehicles. Presentation beyond these deadlines will result in denial of boarding. Passengers who have checked in must remain within the boarding area until they actually board the ship, as they are not permitted to leave this area.In any case, it is the Passenger's obligation to verify well in advance any changes in the ship's departure time and check-in time through the dedicated channels (Ticket Offices, Travel Agencies, website www.gnv.it).4.1 Passengers with reduced mobility during embarkation and while waiting at the apron will be given instructions on how to park their car at the garage deck in order to reach the lifts more easily.Art. 5 MISSED DEPARTURE: Passengers who do not present themselves in the time indicated above for check-in, or who do not board the ship scheduled and indicated on the boarding card, do not have the right to a refund, even partial, of the price paid and must in fact complete the payment of the passage price if they had not paid it in full. Furthermore, no refund will be granted in the following cases (i) denied boarding for security reasons, even if the Passenger shows up within the aforementioned times; (ii) if the Passenger is in possession of documentation that is not suitable for boarding or disembarkation at the port of destination; (iii) if the Passenger, after having checked in, does not present him/herself in time for boarding; (iv) if the Passenger is not indicated in the ticket's names, (v) if the Passenger is not in possession of a suitable health document in relation to the applicable health protocols (e.g. green pass and/or PCR test no more than 48 hours prior to scheduled departure)Art. 6 WITHDRAWAL AND REFUND: Withdrawals must be communicated by the Passenger to the Company directly or through the Travel Agency within the following time limits and with the application of the following penalties: from the time of booking until 20 days before departure 25%; from 19 days until 4 days before departure 30%; from 3 days until 2 hours before departure 50%. Tickets purchased in advance are non-refundable. The aforementioned deductions are applied to the total of Passenger fares, booked vehicles and related surcharges and taxes. The date and time of cancellation must be noted on the ticket by the company or travel agency that issued the ticket. The calculation of the time limit starts on the day following the date of cancellation and includes the date of departure. No reimbursement is due to anyone who cancels/cancels less than two hours before the scheduled departure time, or to anyone who does not arrive in the time set for embarkation without having given prior notice to the Company of the occurrence of one of the circumstances set out in Article 400 of the Nav. Code. In the event of cancellation of a ticket that has already been modified, the most onerous penalty assessed according to the date of the modification will be applied. The possibility of partial cancellation of the ticket is not foreseen, therefore the cancellation is understood to refer to the entire ticket. Passengers are advised to take out an insurance policy to cover the above-mentioned cancellation penalties.Tickets issued with a promotional fare code are refundable and changeable. Tickets issued with a special return fare code can only be cancelled at the same time for both the outward and return legs.Tickets are refundable and modifiable and in the event of cancellation due to withdrawal by the Passenger:from the time of booking up to 4 days before the scheduled departure no penalty applies; from 3 days up to 2 hours before departure 50% The Passenger who does not make use of the purchased journey is entitled to request reimbursement of the port ”fees“, by sending a written request, by registered mail with return receipt, to the Contracting Carrier at its head office in Genoa - via Balleydier, 7 cap. 16149On routes to/from Morocco, for tickets issued from 29.6.2021 onwards, the following penalties will be applied to withdrawal conditions:from the time of booking up to 20 days before departure 25%; from 19 days up to 4 days before departure 30% from 3 days up to 2 hours before departure 50%. Tickets purchased in advance are non-refundable, limited to the amount paid in advance and until actual conversion into a final ticket.On routes to and from Tunisia, for tickets issued from 05.07.2021 onwards the following cancellation fees apply:from the time of booking up to 20 days before departure 25%; from 19 days up to 4 days before departure 30% from 3 days up to 2 hours before departure 50%; Tickets purchased in advance are non-refundable, limited to the amount paid in advance and until the actual conversion into a final ticket.On routes to and from Sicily and to and from Sardinia, for tickets issued from 01.08.2021, the following penalties apply to cancellation conditions:from the time of booking up to 20 days before departure 25%; from 19 days up to 4 days prior to departure 30%; from 3 days up to 2 hours before departure 50%; tickets purchased in advance are non-refundable, limited to the amount paid in advance and until actual conversion into a final ticket. The aforementioned deductions are applied to the total of Passenger fares, booked vehicles and related surcharges and taxes. The date and time of cancellation must be noted on the ticket by the company or travel agency that issued the ticket. The calculation of the time limit begins on the day following the date of cancellation and includes the date of departure. Passengers are advised to take out an insurance policy to cover the above-mentioned cancellation penalties.Only for the routes to Sicily and Sardinia, until 24.10.2021, in case of substitutions on the ticket, no ”substitution fee’ will be applied.On the routes to and from the Balearic Islands and to and from Albania, until 24.10.2021, it is possible to cancel the ticket without penalty up to 4 days before departure and in case of substitutions on the ticket no “substitution fee” will be applied.6.1 For bookings made in the period between 25/10/2021 and before 8/11/21:(i) for travel from February to September 2022 on all routes operated by GNV the Passenger will be able to enjoy:Greater flexibility in the planning of their journey, thanks to the elimination of cancellation penalties (up to 4 days before departure) and replacement penalties exclusively on the routes to/from the Balearic Islands and to/from Albania (in the event of a change to the ticket, the Passenger will only be required to pay any difference in the fare of the new booking, determined, by way of example, by: date changes, added meals, people, etc.).(ii) for pre-salesPossibility of purchasing in presale mode by paying a lower, reduced amount from 30% to 10% of the total ticket price (minimum €50.00). The pre-sale cannot be modified or cancelled and failure to confirm the departure will result in the loss of the amount paid. Free cancellation penalties will only be applied if the pre-sale purchase is paid within the validity period of the free cancellation penalties; cancellation policies for final tickets are subject to the General Conditions of Passenger Transport in force on the date of conversion. 6.2 The conditions referred to in paragraph 6.1 may be extended and/or modified upon prior notice in the dedicated section of the website www.gnv.it/it/prenota-sereno/safe.Art. 7 VARIATIONS:In the event of ticket changes, no fixed fee will be payable, but only the possible adjustment of taxes and bunker surcharge, i.e. the amount that will be fixed in advance and published, and any fare differences if the change results in a higher fare than the original one (excluding the lines to/from Tunisia from 5/07/2021, lines Sète - Tangier, Sète - Nador and Genoa-Tangier, the latter for issues from 29/06/2021: the replacement of the ticket entails the application of a €50.00 fee on the lines to/from Morocco and on the lines Genoa-Barcelona, Genoa-Tunis and Civitavecchia-Tunis, and €20 on the line Palermo-Tunis and (iii) €25 on the Italian domestic cabotage lines (e.e.g. Genoa-Palermo, Genoa-Porto Torres, Genoa-Olbia, Civitavecchia-Palermo/Termini Imerese, Civitavecchia-Olbia, Naples-Palermo). Tickets issued at a special return fare (A/R) may only be changed at the same time by charging the fixed fees on both tickets. Changes are not permitted when check-in is in progress. For all tickets issued at special and/or special conditions, no changes are permitted. Any change in the issued ticket does not entitle the passenger to a refund, while the difference in the changed ticket is payable if the change results in a higher accommodation and/or price. Tickets can be changed via www.gnv.it, the Contact Centre and via an authorised travel agency. Tickets purchased in advance cannot be changed until after conversion into a final ticket and payment in fullArt. 8 DEPARTURE PREPARTIONS/DELAYS OF DEPARTURES OR ARRIVALS - SUPPRESSIONS OF DEPARTURES - ITINERARY CHANGES: the Passenger must ascertain, prior to departure, that there have been no changes to the timetable shown on the ticket. The Company, for the cases foreseen by the Navigation Code and for cases of objective necessity and/or force majeure, has the right to cancel the announced departure, to add or omit stopovers; to start the journey from a port other than the one established, to assign the ship to another line, to bring forward or delay the departure date, to replace the ship that will carry out the transport. Should the Passenger be re-routed on a voyage operated by another carrier and with a ticket issued by the latter, the carriage will be governed according to the GTCT of the actual carrier.8.1 In the event of a delay in departure, the Passenger is in any case guaranteed the rights and assistance provided for in articles 16, 17 and 18 of EU Regulation No. 1177/2010, subject to the exemptions provided for in article 20 of the same Regulation.8.2 In the event of a delay on arrival at the port of destination, the Passenger is in any case guaranteed the rights and assistance provided for in articles 16, 17 and 18 of Regulation (EU) No 1177/2010, subject to the exemptions provided for in article 20 of the same Regulation:economic compensation equal to 25 % of the ticket price for a delay of at least:i. two (2) hours in a regular service lasting between four and eight hours;ii. three (3) hours in a regular service lasting between eight and twenty-four hours;iii. six (6) hours in a regular service of more than twenty-four hours.If the delay exceeds twice the time stated above, the compensation shall be 50 % of the ticket price8.3 In the event of cancellation of a journey, or an extended delay, passengers shall be entitled to refreshments and meals in reasonable relation to their waiting time. These provisions are applicable in relation to the duration of the expected delay and the distance to the port of destination. In addition, the operating carrier will provide hotel accommodation (or accommodation on board a docked ship) if necessary, as well as transport from the port to the place of accommodation. Passengers will be informed by the carrier of arrangements in relation to obtaining refreshments, transport and hotel (or shipboard) accommodation.8.4 The Master, for the cases provided for by the Code of Navigation and for cases of objective necessity and/or force majeure, has full authority to proceed unmanned, to tow and assist other ships under any circumstances, to deviate from the ordinary route in any direction, for any distance and any purpose that may be attributable to his duties as Master, as provided for by the Code of Navigation and by International Conventions, and in this sense to touch, both before and after departure, any port or ports that are or are not on the ship's itinerary, even if in the opposite direction or beyond the usual route, either by reversing or advancing in any order for any purpose, one or more times, to transfer the Passenger and the vehicle to any other ship or means of transport, whether or not belonging to the Company, bound for the port of destination.8.5 The carrier shall not be liable for any damage caused to the Passenger by the delay or non-performance of the carriage if the event is the result of unforeseeable circumstances, force majeure, adverse weather and sea conditions, strikes and technical failures constituting force majeure or other causes not attributable to the carrier and in any case in accordance with the provisions of articles 402, 403, 404 and 408 of the Navigation Code and EU Regulation No. 1177/2010.8.6 To submit a complaint relating to inconveniences, delays and/or trip cancellations, or a request for compensation, the Customer may contact Grandi Navi Veloci by filling in the appropriate online form on the website www.gnv.it in the ”Complaints“ section. Alternatively, claimants may write to Grandi Navi Veloci S.p.A., Customer Care, via Balleydier, 7 - 16149 Genoa (Italy) or by fax to 0039 010 55 09 302. The person making the request must be one of the passengers. Applicants must provide their name and contact details, ticket number and details of the journey concerned. Requests for compensation may only relate to the persons named in the booking itself.8.6.1 Claims regarding cargo, accompanied vehicles and passenger accidents are handled by the Legal, Litigation & Insurance Department to which the interested parties may write to Grandi Navi Veloci S.p.A., Legal, Litigation & Insurance Department, via Balleydier, 7 - 16149 Genoa (Italy) or send them by fax to +39 010 5509336.Passengers are also informed that each Member State has designated one or more bodies responsible for the enforcement of Regulation 1177/2010 (http://www.autorita-trasporti.it /)8.7 The Passenger's rights in relation to a delay and/or to request compensation shall lapse if they are not exercised and submitted to the carrier's Customer Care department within two months from the date on which the service was performed or should have been performed. For any complaint in relation to the possibility of exercising the rights due to the Passenger, the Customer Care office is available by filling in the appropriate on-line form on the website www.gnv.it in the Complaints Section by accessing through the link https://www.gnv.it/it/assistenza/contatti/segnalazioni or by calling the fax number +39 010 5509302.Art. 9 BOARDING AND DISEMBARKATION OF VEHICLES: the vehicles shall be called for boarding in the order ordered by the Master of the vessel and/or his auxiliaries and officers. Vehicle embarkation operations, including their arrangement in the place assigned on board (each vehicle must be parked with the handbrake pulled and the gear engaged), disembarkation operations as well as the possible transfer of the vehicle from the parking place to the ship and/or the possible transfer of the vehicle from the ship to the parking place are always carried out at the exclusive care, risk and responsibility of the Passenger, except in the case of proven defect of the state of the place/ship. The Passenger also remains exclusively responsible for any damage to their vehicle, the goods and luggage contained therein, their person as well as the persons present in the vehicle. The Passenger is also exclusively liable for any damage caused to third parties, their vehicles, goods and luggage (except as provided for in Art. 412 of the Nav. Code). During embarkation/disembarkation, only drivers shall have access to the garage; other passengers shall board and disembark from the appropriate pedestrian accesses. In the event of non-compliance, the Company shall not accept liability for any damage to property or persons. The vehicle, including any trailer and/or caravan, with its contents, is accepted by the carrier as a single load unit without declaration of value. Therefore, any liability of the carrier for loss of and/or damage to the vehicle shall not exceed the limit set out in article 423 of the Navigation Code, except in the case of liability due to wilful misconduct or gross negligence. Any Passenger wishing to declare the value of the accompanying vehicle must formalise this in writing prior to booking; the cost of transporting the vehicle will depend on the declared value.The Passenger must declare the correct measurements (overall; e.g. including luggage on the roof), the type of vehicle and the licence plate when making the reservation; in the event that what is declared does not comply, the Passenger will be required to pay the corresponding tariff differences and ”fee“ for ticket changes. The Company reserves the right not to embark vehicles that do not comply with what is declared during the booking process in the event of lack of availability of suitable ship garage spaces.LPG and methane powered vehicles must be reported to the staff upon boarding. They will be parked in an ad hoc section in the ferry garage.Art. 10 RULES TO BE OBSERVED BY THE PASSENGER: the Passenger is required to comply with the requirements of Italian and international laws, and the General Conditions of Passenger Transport (CGTP) published on the website www.gnv.it and in any case displayed at GNV sales points, as well as the instructions given by the Captain of the ship. In addition, the Passenger is directly liable to the Company for all infringements, harassment, fines and expenses to which, due to their actions, the Company is subjected by the port, customs, health and/or any other authority of any country. In the event of an emergency, Passengers shall place themselves at the disposal of the Master and Officers and shall carry out the orders and prescriptions they receive in a disciplined manner. The above is without prejudice to the fact that the GNV Company reserves the right to denounce any passenger who is responsible for the aforementioned behaviour if it constitutes a criminal or disciplinary offence, in accordance with the applicable regulations.10.1 Passengers are also obliged to comply with the provisions of the Maritime Carrier that prohibit smoking in the ship's interior areas that are appropriately signposted.10.2 Passengers are obliged, at their own care, expense and responsibility, to check, before embarkation, the suitability of their identity documents and those relating to any accompanying vehicles, at the appropriate Police Authorities, in order to ascertain that they are suitable for entry into the country of disembarkation and valid. The company will not reimburse those Passengers who have not been authorised by the Border Police and/or the company to embark or disembark because they have been found to have documents that are not suitable for expatriation; the company reserves the right to claim against the Passenger for any costs and/or penalties that it may receive as a consequence of the aforementioned circumstances.The Passenger is liable for all damages, however caused by him/her or by persons or animals in his/her custody, to the ship's furnishings, its appurtenances and accessories, its equipment, as well as to other Passengers, the Carrier's employees or its auxiliaries.If the passenger on board jeopardises the safety of the voyage, disturbs other passengers and the crew or behaves in any case in such a way as to cause them discomfort, obstructs the crew in the performance of their duties, does not comply with the instructions of the Captain of the vessel and his officers regarding correct behaviour on board or compliance with procedures, they may be subject to the measures necessary to prevent or limit such behaviour, including any coercive measures within the limits of the law, as well as disembarkation or refusal to continue the carriage.Grandi Navi Veloci reserves the right not to embark on its ships anyone who, on previous occasions/trips, has adopted conduct in violation of the provisions of paragraph 10.4 of the General Passenger Transport Conditions (GTP) in force.Art 11 TRANSPORTATION OF UNACCOMPANIED MINORS: IPassengers under 14 years of age may not travel alone. They must be constantly supervised by their parents and/or adults who have custody of them and cannot travel on the ship unaccompanied. Under no circumstances will the Carrier be liable for any damage occurring to minors in violation of the above. If the minor travels in the care of other persons, he/she must be provided with a declaration of indemnity for the Carrier, in which the parents, or whoever exercises parental authority, declare that they are entrusting the minor to a designated person, who will be responsible for him/her for all legal purposes. This declaration must be accompanied by a photocopy of the valid identity document of each declarant. It is understood that the Passenger will be responsible for providing all the necessary documentation required by the country of destination and the Carrier assumes no liability in the event that such documentation should be considered insufficient by the authorities at the port of destination. We remind you that if the minor is travelling accompanied by only one parent, written authorisation of consent from the other parent and/or legal guardian is required for expatriation.11.1 Underage passengers between 14 and 18 years of age may travel alone, provided that they are in possession of written authorisation from the person exercising parental authority releasing the Carrier from all liability.Art. 12 HEALTH CONDITIONS OF THE PASSENGER: The Captain has the right to refuse passage to anyone who, in his opinion and that of the Company itself, is in such a physical or mental condition as to be considered unfit to travel and/or anyone who is under the effect of drugs, hallucinogens, alcohol, illness or infirmity, and whose condition may represent a danger to themselves or to the safety of other Passengers. In all the aforementioned cases, the Passenger will not have the right to compensation for damages and will in turn be liable for damages caused to the ship, to all its fittings and equipment, to third parties as well as to third parties” property. The acceptance of the Passenger on board by the Company shall not be considered as a waiver of any of its rights to subsequently assert its reservations on the conditions of the Passenger whether or not these were known to the Company at the time of embarkation and/or departure of the ship.12.1 In the event that the Master, also on indication of the ship's Doctor, considers that, for any reason whatsoever, the presence on board of the Passenger endangers or may endanger his safety or the safety of the other Passengers, he will be entitled to order his disembarkation in any port. And even for this provision, the Passenger will not have the right to claim from the Company and/or the Carrier any compensation and/or damages for the decisions taken by the Captain.Art.13 PASSENGERS IN NEED OF PARTICULAR ASSISTANCE:The carriage of Passengers with reduced mobility, the disabled, the sick or other persons requiring special assistance must be communicated, with the sending of documentation proving the right, at least 5 days before the scheduled departure to the carrier by telephone by contacting the GNV Contact Centre on +39 010.2094591 and/or at the e-mail address pmr@gnv.it. For special cases, the request must be made at least 5 working days before departure, as the ship does not have the personnel and/or facilities to offer individual replacement services, assistance, care or similar to Passengers. Any assistance offered on board to passengers with special needs is provided free of charge. Passengers using wheelchairs or other mobility aids must bring them with them. The devices on board will be offered until their availability is exhausted, subject to completion of the appropriate form.13.1 PREGNANT WOMEN: A passenger who knows that she is pregnant is required to inform the ship's Master prior to embarkation. In the case of an uncomplicated pregnancy, after the 6th month of pregnancy, the Passenger must obtain a medical certificate attesting to her fitness to undertake the sea voyage, to be presented to the ship's officer who requests it, and she must also fill in the special waiver that can be downloaded from the website www.gnv.it, or at the GNV ticket offices, or by contacting the Grandi Navi Veloci Contact Centre at +39 010.2094591. For other cases, the pregnant passenger must be in possession of a medical certificate authorising travel regardless of the month of pregnancy. However, this is without prejudice to the Captain's discretion as per art. 12 above.Art. 14 EXPLOSIVES, FLAMMABLE AND DANGEROUS SUBSTANCES: it is strictly forbidden for Passengers to include in their luggage or in their belongings placed on board vehicles industrial residues or explosive and/or flammable substances or otherwise dangerous to the safety of the ship, the cargo or the safety of other Passengers and crew members. In the event of an established breach of this prohibition, the Master is authorised to seize or destroy such substances without the Passenger being entitled to claim any indemnity. The Passenger will also be held responsible for the consequences of the infringement of this prohibition.14.1 It is strictly forbidden to light gas or electric stoves, irons and all instruments that can have an open flame on the ship. In the event of seizure of the aforesaid instruments, they will not be returned and nothing can be claimed by way of compensation from the maritime carrier. The Vessel Master shall have the right to seize such instruments and disembark them, reserving the right to lodge a complaint with the competent Authorities. This is also without prejudice to the maritime carrier's right to claim compensation for any prejudice and/or damage to the vessel and/or crew.Art. 15 WEAPONS: Passengers upon embarkation are obliged to hand over in custody to the Master all small arms and/or firearms in their possession. In case of non-compliance, offenders will be liable to confiscation of the weapons and referral to the competent Judicial Authority.Art. 16 BAGGAGE: baggage not handed over to the carrier must contain only belongings for the Passenger's personal use. All valuables, jewellery, cash, traveller's cheques, etc. may be deposited in the ship's safety deposit boxes or, failing that, delivered in a closed and sealed envelope to the Purser who will issue a receipt for the envelope without checking its contents. If it is ascertained that the baggage not handed over to the Carrier contains objects not for personal use, the Passenger must pay three times the fare for the carriage of such objects in addition to compensation for any damage. It is in any case agreed that the liability of the carrier for baggage and objects not handed over to the carrier is also limited to the maximum amount resulting from any written declaration of value issued by the Passenger, provided that the latter has paid the higher freight. Otherwise, the limit of Article 412 of the Navigation Code will apply.16.1 Only two packages containing personal effects (clothing only) are allowed as free hand baggage. Excess hand luggage may be stowed in a container at a charge of Euro 10.00 per piece on routes to and from Tunisia.16.2 Excess baggage (used household goods, used household appliances, used furniture, etc.) not carried on the roof of the car at the time of embarkation may be stowed in a container provided by the Company at a cost of Euro 20.00 per piece on routes to and from Tunisia. It is not permitted to import household appliances from Tunisia and/or Morocco that do not comply with EEC directives.Art. 17. LOSS AND/OR DAMAGE OF BAGGAGE AND EFFECTSPERSONAL PROPERTY OR VEHICLE: the loss and/or damage of the luggage and other personal effects or of the vehicle accompanied by the Passenger must be reported by the Passenger to the Command of the ship or to the agents and/or officers of the Company in the port of disembarkation - under penalty of forfeiture - at the time of delivery if it is an apparent loss or damage, or within three days of delivery if it is not apparent. For luggage and objects not handed over by the Passenger to the carrier, the latter is not liable for loss and/or damage unless the Passenger proves that such loss and/or damage was caused by a cause attributable to the carrier. In any case, the carrier is not liable for loss and/or damage attributable to vandalism and/or wilful acts of third parties.17.1 The carrier has set up a ’Lost & Found“ (lost and found) service that can be contacted by e-mail lostandfound@gnv.it or by fax at +39 010 5509302Art. 18 PETS: the carriage of small pets (cats, dogs, etc. as defined by EU Reg. 576/2013 - All. I Part A.) accompanying Passengers is permitted on condition that they are provided with a health certificate, are carried on a leash and muzzle and that the relevant ticket has been purchased. In accordance with EU Reg. 576/2013 Art. 5, pets (of the species listed in Annex I Part A) may accompany the owner or a person authorised by the owner in a number not exceeding 5. In order to comply with health and hygiene regulations, pets, when accepted by the Company, must travel either in the dedicated cabins (maximum number allowed is 2 animals per cabin) or in the kennel or cattery. The person travelling with a pet is required to present the identification document required for any non-commercial transport. The Passenger using the ”four-legged friends“ cabin is responsible for the conduct of the animal throughout the journey. It is forbidden for animals to remain in the common areas; an outdoor area is available for animals to walk around, in which they must be led with a leash and muzzle. As a partial exception to the above, access to the ship's premises is permitted for guide dogs accompanying visually-impaired Passengers and Civil Defence dogs with appropriate certification and on duty. Passengers are liable for any damage caused to property or third parties by their animals. The Carrier declines any responsibility for any seizure or suppression of animals by the Sanitary Authorities of the port of disembarkation/embarkation, as well as for any damage to animals, for their escape, loss or death occurring during transport or during embarkation and disembarkation, except in the event of proven cases of wilful misconduct and/or fault attributable to the Carrier. The Passenger is in any case required at all times to behave appropriately and diligently in order to avoid and/or prevent such problems. The Passenger is also required to check that the animals transported are in order with all the sanitary documentation required at the time of the journey by the regulations in force from/to the port of destination. The GNV Company will not reimburse those Passengers who are not authorised by the Border Police and/or the Health Authority and/or the Company itself to embark and/or disembark, as they do not have the appropriate health certification for their pet.Art. 19 INFORMATION ON PASSENGERS: Upon boarding, passengers are required to inform them of any need for assistance or special care as per Art. 13.Passengers are also required to communicate their personal details at the time of booking, understood as: full name and surname (in compliance with Ministerial Decree 83/T 20/6/2007 of the Ministry of Transport), date of birth, gender, age category (infant, child, adult). It is the Passenger's obligation to communicate any changes in personal data between the time of booking and the time of boarding. Personal data is collected in accordance with Decree Law No. 251 of 13.10.1999 implementing EEC Directive 98/41 of 18.06.1998, with the regulations relating to the application of the ISPS code on anti-terrorist regulations, as well as in compliance with the provisions of European Regulation 2016/679 (GDPR) on the subject of privacy and, again, with Legislative Decree No. 196/2003 on the subject of privacy.At the time of booking, the Passenger will be asked to provide their own mobile phone number and e-mail address. Any cancellations and/or changes will be communicated to the passenger via the telephone number provided at the time of booking (also via SMS). GNV is not responsible for the impossibility of telephone contact in the event of a missing number, unreachable number, wrong number.The carrier has the right to use the personal data provided by the passenger, including information concerning purchases for the purpose of:-make a reservation and/or issue a ticket;-providing transport and related services;-accounting, invoicing, auditing;-verification and control of credit and other payment cards;-information notices related to the purchased trip (e.g. in case of schedule changes and/or cancellations); -immigration checks;-control, security, health, administrative and legal purposes;-marketing activities, market research, statistical analysis, development of new services (which will only be carried out with the Passenger's consent or for which the Carrier will give the Passenger the option to be excluded).The Passenger, solely for the above-mentioned purposes, authorises the carrier to use and, where necessary, transmit the personal data provided to:-the carrier's port and commercial agents limited to the performance of services for the journey purchased;-States and public entities, where required and in accordance with applicable law;Art.20 APPLICABLE LAW AND COURT OF JURISDICTION: the contract for the carriage of Passengers, their luggage and accompanying vehicles is governed by the Navigation Code, Regulation (EU) No. 1177/2010, the SOLAS Regulation and interpreted in accordance with Italian law. The following are the general conditions of carriage of the company in question.GENERAL CONDITIONSGrimaldi Compagnia di Navigazione operates as agent for the Carriers: Atlantica SpA di Navigazione and Grimaldi & Suardiaz Lines SpA . The Carrier of the maritime route travelled is indicated on the ticket. Passengers, their luggage and accompanied vehicles are carried exclusively under the Carrier's Pacts and Conditions. The passenger, by purchasing the ticket, accepts ipso facto these Covenants and Conditions hereunder.DEFINITIONSCarrier“ means the shipowner or the owner of the vessel performing the maritime transport service. Baggage” means the passenger's hand luggage not checked in or stored in his or her own vehicle parked in the ship's garage or deposited in the ship's boot, and containing only the passenger's personal belongings. Accompanied vehicle“ means any motor vehicle (including towed vehicles, if any), used for the carriage of persons, mixed or goods not for sale, owned by, or legally at the disposal of, the passenger named on the passage ticket.POWER OF THE CAPTAINThe Master of the ship has full power to proceed without pilot, to tow and assist other ships under any circumstances, to deviate from the ordinary route, to call at any port (whether or not it is on the ship's itinerary) to transfer the passenger and his luggage to another ship for the continuation of the voyage. The Carrier and on its behalf the Master of the ship has the right to refuse embarkation to anyone who, in its sole discretion, is in a state of health that does not allow them to undertake the journey. Furthermore, the carrier, and on its behalf the ship's Master, has the right to disembark during the voyage, at any intermediate port, any passenger who is in a state of health that does not allow the voyage to continue or who causes danger or inconvenience to other passengers or the crew. The passenger shall be subject to the disciplinary powers of the Master of the ship for all matters relating to the safety of the ship and navigation. The Carrier and the Master of the ship shall have the authority to carry out any order or directive given by Governments and Authorities of any State or by subjects acting or purporting to act on behalf of or with the consent of such Governments or Authorities or any other subject who, under the terms of the ship's war risk insurance cover, is entitled to give such orders or directives. All actions and omissions by the carrier or the Master in pursuance of or as a consequence of such orders or directives shall not be considered a breach of contract. The disembarkation of passengers and baggage in accordance with such orders or directives releases the carrier from any liability for the continuation of the voyage or the repatriation of passengers.SHIPSThe ships in service are Ferry Ro\Pax or CRUISE Ferry Passengers, used for the transport of passengers and goods. The announced timetables may be subject to change due to weather, port operations, port traffic, even without prior notice being given to passengers. Any resulting delay does not entitle passengers to cancel their journey and under no circumstances does it entitle them to reimbursement, compensation or compensation of any kind.RESERVATIONSReservations can be made at a Travel Agent or via www.elladeviaggi.it. The ticket is payable upon confirmation. Freight payment is due to Grimaldi Lines at the time of booking. Failure to pay the full freight charge does not guarantee a seat reservation. No passage ticket can be issued without payment of the same. In compliance with the Security regulations, the names of the passengers, the details of their identity documents, the make, type and plate number of the vehicles indicated on the ticket must necessarily correspond to the passengers and their departing vehicles. Otherwise, access to port gates and boarding may be refused.APPLICABLE RULESThe contract of carriage of passengers, their luggage and accompanying vehicles is governed by the Italian Code of Navigation as interpreted in accordance with Italian Law and by the relevant International Conventions such as the Athens Convention of 13/1/1974 as amended by the London Protocol of 19/1976.TICKETS (Contract of Carriage)A ticket is valid only for the persons to whom it is issued. A ticket cannot be transferred. The ticket may be presented in paper, fax, e-mail or digital form. Smoking is forbidden on board in all covered areas. The personnel on board are legitimately in charge of supervising compliance with this prohibition and reporting any non-compliance to the competent authorities in accordance with Law 3 of 16/103 and its implementing agreement of 16/104. Failure to comply with a provision of the law, ship's regulations, order or regulation of the Authorities on security matters is punishable in accordance with the civil and criminal laws in force. In accordance with current anti-terrorist regulations (ISPS), passengers may at any time be subject to baggage inspection and/or be asked to produce identity documents by the ship's officers.BOARDINGPassengers with vehicles must present themselves for embarkation (check-in) at least one and a half hours prior to departure (to/from Tunisia three hours prior). Passengers without vehicles must present themselves for embarkation at least one hour before departure (from/to Tunisia three hours before). For all departures from Tangier from 17:00, check-in operations will take place until 14:00. After this time, boarding may be refused. In high season, queues must be taken into account. If a passenger does not present himself or herself within the aforementioned time limit, he or she loses the right to boarding even if he or she has a reservation. At the time of embarkation, he or she must be in possession of a regular ticket, a valid identity document and any documents required for disembarkation in the country of final destination and any countries to which the ship calls. Vehicles will be called for embarkation in the order that will be arranged by the Master of the vessel and/or his subordinates and attendants, and may be placed on any deck of the vessel.TRAVEL DOCUMENTSEU citizen: for Tunisia and Morocco, valid passport; for Spain, Malta, Greece, Sardinia and Sicily, valid identity card for expatriation or passport is sufficient. Non-EU citizen: valid passport with a valid residence permit or visa for a Schengen country.BOARDING UNDERAGE PASSENGERSPassengers under 12 years of age: under no circumstances may they travel unless accompanied by a person of legal age. If this is not one of the 2 parents, they must deliver to the ship's Captain / Purser a letter of custody in which the parents declare that they are entrusting their child to a designated person who will be responsible for them for all legal purposes. This letter must be accompanied by the valid identity documents of both parents and, in the case of non-EU nationals, the residence permit of the parents where the child is present will be required; Underage passengers, over 12 years of age: may be admitted on board the vessel provided that they deliver to the Master of the vessel / Purser a letter of release signed by both parents, with the documents of both parents attached, in which they declare that they assume all responsibility for any personal injury and/or damage caused to third parties. Under no circumstances will the Master of the ship and/or any other member of the crew assume custody, and consequent responsibility, of the minor on board the ship; it is understood that the passenger will be responsible for providing all the necessary documentation required by the country of destination and the Carrier assumes no responsibility in the event that such documentation should be considered insufficient by the Authorities in the port of destination.EMBARKING PREGNANT WOMENWomen in a state of advanced pregnancy, beyond the 6th month, may only travel if they have a medical certificate authorising travel issued no more than 7 days prior to the date of departure. On the other hand, if the pregnancy is complicated, the pregnant passenger must have a medical certificate authorising travel regardless of the months of pregnancy. In any case, boarding will not be permitted to women who are due to give birth in the 7 days following departure or who have given birth in the 7 days preceding departure. This is without prejudice to the ship's Captain's right to refuse boarding to a pregnant woman who is, in his sole discretion, in a state of health that does not allow her to undertake the trip. Should the Master refuse to board the passenger for a justified reason, the Carrier will only be required to reimburse the cost of the ticket.HEALTH AND VACCINATIONSPassengers are accepted on the presumption of being in good health, both physical and mental. A first aid station and a hospital cabin are available.INSURANCEThe shipowner and the carrier have an insurance policy issued by the P&I Club only with regard to their liability towards third parties. Passengers are strongly advised to take out insurance against cancellation, baggage, medical expenses and assistance and repatriation. For the accompanying vehicle, see the following paragraph.ACCOMPANIED VEHICLESOnly vehicles not containing merchandise for sale are considered to be accompanying vehicles. A vehicle containing anything other than luggage with personal effects or goods intended for marketing is not allowed as an accompanying vehicle and must travel as cargo. If boarding is denied because the vehicle, entered as a passenger accompanied vehicle, contains goods intended for sale, no refund will be given. Only one accompanying vehicle per passenger is permitted. Tour buses, trucks, trailers, lorries and jumbos with or without drivers must travel as freight. If the vehicle presented for embarkation belongs to a different booking code than the one indicated on the ticket, the passenger loses the right to embarkation (no refund of the ticket). In order to be accepted for embarkation, he/she must pay the difference between the categories plus the change fee. The accompanying vehicle is embarked and disembarked by the passenger, who, once he/she has parked the vehicle at the place indicated by the person in charge on board, must take care to engage the gear and pull the handbrake. The vehicle must be locked. Access to the garage area is peremptorily forbidden during the entire crossing. In the case of vehicles that are not running, it shall be the responsibility of the passenger to provide the Company in advance with a written declaration attesting to the use of a tow truck at his/her own expense, both for embarking and disembarking. In the absence of the aforementioned documentation, access to the ship may be refused. It is mandatory to declare at the time of booking whether the accompanying vehicle is equipped with a natural gas or LPG fuel system. The natural gas fuel system of the vehicles must comply with all applicable regulations and this compliance must be duly certified in the vehicle logbook. During the time that the vehicles are stowed on board, the methane tank shut-off valves must remain closed. The Passenger must be in possession of all documents required for disembarkation and customs clearance of the vehicle at the port of destination. In the event of incomplete said documents, the carrier declines all responsibility. All costs and expenses arising from the embarkation, disembarkation and customs clearance of the vehicle are the responsibility of the passenger. Any damage caused by the vehicle to the vessel and/or third parties must be compensated directly by the Passenger who caused the damage, or through their insurance company. However, the Passenger may at any time be asked to sign a damage liability declaration before disembarking from the ship. Timetables, Itineraries

Schedules are subject to change without prior notice. Jadrolinija reserves the right to cancel the trip or change the itinerary due to force majeure: strikes, riots, bad weather, technical reasons or any other reason. Jadrolinija accepts no liability for the consequences of various changes and delays of any of its scheduled vessels.


Travel documents

On international routes, the passenger is required to comply with legal regulations as well as those of the competent authorities of the country from which he or she is travelling and those of the country to which he or she is going. Furthermore, he/she is obliged to present his/her travel document or visa (if required) at every request either from agencies or control services, if such a procedure is requested of the passenger. Under no circumstances is the passenger entitled to compensation or reimbursement of his or her ticket if the competent authorities prevent him or her from boarding or leaving the ship due to invalid documents. Vehicles are transported only with original documents, while rent-a-car vehicles must have the original rental contract as well as the original or a copy of the registration certificate.


Transport contract

The contract of carriage is deemed to be concluded when the passenger buys a ticket for both passengers and vehicles. By purchasing a travel ticket, the passenger agrees to accept and fully comply with the general conditions of carriage of the Jadrolinija company. According to the sea transport travel ticket, the passenger has the right to travel only on the route indicated on the ticket. The ticket in his or her name cannot be transferred to another person.


Boarding Procedures
Embarkation, in the port where the voyage begins, begins 2-3 hours before the departure of the ship, while in intermediate ports it begins immediately after the arrival of the ship and the disembarkation of vehicles and passengers. Passengers on international routes, even if in possession of their tickets, are required to report to the port agency at least 3 hours prior to the ship's departure as per the timetable. After the aforementioned deadline, the company reserves the right to cancel the booking, which in such a case is non-refundable. Jadrolinija does not guarantee the embarkation of vehicles that are not properly declared, even if they have a ticket. 
 
Unaccompanied vehicles
The Jadrolinija Company accepts no liability for damage incurred during the embarkation/disembarkation of unaccompanied vecoli. 

Warning
Free access to the vehicle during the journey is only possible with the permission of the responsible officer. It is forbidden to carry flammable and explosive materials on board.
 
Payments on board
All payments on board can be made in cash and also by Diners, American Express, Visa and Eurocard/Mastercard.
 
Meals
Meals can be paid for in advance when purchasing the ticket or ordered and paid for directly on board.  

Reductions
If return tickets are issued at the same time, the 20% reduction is applied on the return journey, excluding special offers. Children up to the age of 3 (not yet turned 3) if they do not occupy their own bed or seat travel free of charge (100% reduction). Children aged 3 to 12 (not yet 12 years) are entitled to 75% discount. Children under the age of 12 may not travel alone on Jadrolinija ferries, but must be accompanied by an adult. Discounts cannot be combined and do not apply to meals and taxes.
 
Rates and conditions for groups (minimum 15 persons) - on request

Cancellations and RefundsAny cancellation, whether of the full or partial service, must be made prior to the vessel's departure, either at one of the Jadrolinijia agencies or at the agency that made the reservation or issued the ticket. Refunds will be subject to the following deductions:
  • 1. before the departure of the detained vessel
  • up to 22 days 10%
  • 8 to 21 days 20%
  • 1 to 7 days 30%
  • on the day of departure 100%
  • 2. Meal cancellations without withholding.
  • 3. No reimbursement will be granted to the passenger if he/she wishes to interrupt the journey at one of the intermediate ports, or in the case of a non-cancelled booking, or in the case of a “no show” (passengers who did not show up for embarkation).

Refunds are made exclusively by the agency that issued the ticket, provided that the date of cancellation is confirmed on the ticket with the stamp and signature of the office responsible (travel agency, port of embarkation office).

One change to the travel ticket is possible without penalty prior to departure by sending a written request, or by compulsorily presenting the travel ticket if the passenger already has one, except for commercial vehicles on the day of departure.


Complaints
Complaints are considered within 15 days of the end of the trip at the latest.

Liability’
Jadrolinija limits its liability, in case of death or injury of the passenger, to the amount determined by the Maritime Law of the Republic of Croatia. Jadrolinija is liable for damage to or loss of valuables, documents and money only if they are deposited in the office on board (and with confirmation of receipt).
 
Dogs and other pets
All animals on board must have a valid health certificate. Dogs must be muzzled except guide dogs for the blind. The feeding of animals is the responsibility of their owners and their transport is free of charge. Dogs must be on a leash, cats must be carried in baskets/containers and birds in cages. Animals are not permitted in public areas (lounge, restaurant, cabins and toilets). Guide dogs for the blind may be kept in all passenger spaces.

A ticket converted to opendate ticket is valid for one year from the date of issue (not print or reservation) of the initial ticket and, if cancelled, it is refunded according to the cancellation policy of the initial ticket. Passengerswith an open return ticket must reserve their return journey well in advance through the travelagency, Premium Sales Agent, port agency or the offices of the Company, where reservation andpayment were made. Open return fares are always calculated based on the low season fare. In theevent that a passenger travels in shoulder or high season or during a period in which a new tariffis in force, then the difference between the current and the pre-paid fare has to be paid by thepassenger. Reservation takes place according to availability. The Company cannot always securethe reservation of the passengers on their desired travel dates or accommodation type. Alternativetravel dates or accommodation types may be offered.Lost TicketsIn case of a lost ticket, the passenger must immediately notify the issuing travel agent, Premium Sales Agent,port agent or the Company. The reprinted ticket can only be picked up by the travelling passenger with valid identification at the port of departure. (hereinafter also referred to as the Company) undertakes the carriage of persons, their luggage and accompanying vehicles in accordance with these General Conditions, which are considered known and accepted by anyone purchasing or using tickets for the Company. For that which is not regulated by these General Conditions, the transport of persons, their luggage and accompanying vehicles is governed exclusively by Italian law and by the relevant international conventions ratified and made executive by Italy. Consequently, the correlative liability of AFH S.p.a. for personal injury and for damage and/or loss of luggage and motor vehicles is subject to the limits of Italian law and the relevant international conventions ratified and made executive by Italy.
2. VALIDITY: the ticket is personal, non-transferable and valid only for the carriage specified therein. The Passenger is obliged to diligently keep the contract/ticket in order to justify his right to travel and to show it to any Ship's Officer or Company official who may request it. A Passenger without a ticket must notify the Master and/or Purser immediately. Failing this, he/she will be required to pay double the price of the passage to the port of destination, without prejudice, however, to compensation for damages.
3. PASSAGE PRICES: The price indicated in the passage ticket is that of the carrier's tariff in force on the date of its issue. Ticket prices include carriage by sea.
They do not include the cost of cancelling the trip, nor the cost of booking or changing tickets, which may be required by the Company's Travel Agencies or agencies. Meals are not included in the price of passage. Their payment will be made directly on board. Rights, expenses and fees for embarking and disembarking passengers and accompanying vehicles, which are not included in the passage price, will be settled in the same ticket under a separate item.
4. REDUCTIONS: Reductions in ticket prices must be requested by those who are entitled to them before the ticket is issued and against presentation of supporting documents. The reductions granted by the Company are published in the information leaflets distributed periodically and on the Company's website. .
5. OPEN-DATE TICKETS: Open-date tickets are valid six months from the date of issue. Reservations and the corresponding seat allocation on board for the desired date, particularly during the high season, must be requested well in advance. In all cases, passage is subject to the availability of a seat on board. Passengers are required to settle any differences in fares upon boarding.
6. LOST TICKETS: The loss or theft of a ticket must be reported promptly to the Port Agencies, who will arrange for it to be frozen.
In the event of theft, the Passenger, on the day of departure, will obtain, at the boarding gate and upon presentation of the report drawn up by the competent Authority, a duplicate of the ticket without further payment of the fare. In the event that the passenger, after theft, renounces the trip, reimbursement of the ticket must be requested from the company, under penalty of forfeiture, within 180 days. In the event of loss, on the day of departure, the Passenger, by repaying the full amount of the ticket, will be able to obtain a duplicate of the original ticket at the embarkation point, using the same accommodations that were previously allocated. After a period of 180 days has elapsed without the lost ticket being used, the Company will proceed with the reimbursement.
7. CANCELLATIONS, DECLASIONS AND REFUNDS: The cancellation and downgrading of a ticket with a fixed seat shall be subject to the following penalties:
- from the day following the date of issue and up to 7 days before departure: penalty of 10% of the ticket price;
- from 6 days to the day before departure: penalty of 25% of the ticket price;
- the day of departure: penalty of 50% of the ticket price.
Passengers who, without having cancelled their trip in advance, do not present themselves for embarkation or do not board the vessel scheduled and indicated on the embarkation card are not entitled to a refund, even partial, of the price paid and must in fact complete payment of the passage price if they had not paid it in full.
The aforementioned deductions shall be applied to the total of the Passenger fares, booked vehicles and related surcharges and taxes. The date and time of cancellation must be noted on the ticket by the company or travel agency that issued the ticket. The calculation of the time limit starts on the day following the date of cancellation and includes the date of departure. No reimbursement is due to those who cancel/cancel less than two hours before the scheduled departure, to those who do not present themselves at the time established for embarkation without having given prior notice to the Company of the occurrence of one of the circumstances envisaged by Article 400 of the Code of Navigation, as well as to those who communicate partial cancellations only when checking in for embarkation. In the event of cancellation of a ticket that has already been modified, the most onerous penalty assessed according to the date on which the modifications were made will be applied.
Refunds are made in the country where the ticket was issued, via the issuing office, provided that the date of cancellation is recorded in the computerised procedure or is confirmed in writing, with stamp and signature of the person responsible, by the office at the port of embarkation. Return “open date” tickets may be refunded within the terms of their validity, subject to a penalty of 10%.
8. CHECK-IN AND BOARDING: Timetables and itineraries indicated in the illustrative brochures are indicative and may be subject to change: before going to boarding, Passengers are invited to check the timetables and itineraries of their chosen journey at the Company's head office or agencies or on the Company's website.
The Company, in cases of objective necessity and/or force majeure, has the right to cancel the announced departure, to add or omit stopovers; to start the journey from a port other than the established one, to assign the ship to another line, to anticipate or delay the departure date. In the event that departure is delayed for more than 12 hours with respect to the scheduled departure time, the Passenger will have the right to terminate the contract and obtain reimbursement of the price relating to the unused passage, less the agency commission.
The Master, for the cases foreseen by the Navigation Code and for cases of objective necessity and/or force majeure, has full authority to proceed without pilot, to tow and assist other ships in any circumstance, to deviate from the ordinary route in any direction, for any distance and any purpose as per his duties as Master, as foreseen by the Navigation Code and International Conventions, and in this sense to touch both before and after departure any port or ports that may or may not be on the ship's itinerary, even if in the opposite direction or beyond the usual route, either by going backwards or forwards in any order for any purpose, one or more times, to transfer the Passenger and the vehicle to any other ship or means of transport, whether or not belonging to the Company, bound for the port of destination. The times of departure and arrival specified by the Company shall be understood as “pilot/pilot”. The time of arrival, if specified in the ticket, or otherwise communicated by the Company or its agents is purely indicative and the carrier is not liable for any delay due to unforeseeable circumstances or force majeure; more specifically, the carrier will not be liable for any damage caused to the Passenger by the delay or non-execution of the carriage if the event is the result of unforeseeable circumstances, force majeure, adverse weather and sea conditions, strikes and technical failures constituting force majeure or other causes not attributable to the carrier and in any case in compliance with the provisions of Articles 402, 403, 404 and 408 of the Navigation Code. Passengers with tickets do not have to embark directly, but must present themselves at the embarkation station at least three hours prior to departure (also valid for groups): after this time, the Company reserves the right to cancel the corresponding bookings and to accept other passengers waiting. Passengers will be given a boarding pass that must be validated for boarding by the Border Police office. Passengers must be in possession of a passport or other recognised document, visas and any required international vaccination certificates. The company is not liable in the event of missed departure due to documents that are not in order for expatriation, therefore no reimbursement is provided.
9. LOADING AND UNLOADING OF VEHICLES: All vehicles are to be considered as “not carrying goods”. Vehicle lengths are to be considered overall, including towbars, drawbars or other. Camper vans, caravans, off-road vehicles or any other vehicles with an overall height of more than 1.80 m from the ground, must be indicated at the time of booking and appear on the ticket. Failure to comply with the above may result in the cancellation of the booking and consequent non-boarding, automatic placement on the waiting list for the day, and boarding on the ship will only be authorised if there is garage space available and upon payment of the fare difference due. Vehicles will be called for boarding in the order that will be ordered by the Master of the vessel and/or his aides and agents. Vehicle embarkation operations, including their arrangement in the place assigned on board (each vehicle must be parked with the engine and lights off, as well as with the handbrake on and gear engaged), disembarkation operations as well as any transfer of the vehicle from the parking place to the ship and/or any transfer of the vehicle from the ship to the parking place are always carried out at the sole care, risk and responsibility of the Passenger, even when he/she receives manoeuvring advice from the ship's personnel, except in the case of proven defect of the state of the place/ship. The Passenger is also exclusively responsible for any damage to their vehicle, to the goods and luggage contained therein, to their person as well as to the persons present in the vehicle. The Passenger is also exclusively liable for any damage caused to third parties, their vehicles, goods and luggage. The vehicle, including any trailer and/or caravan, with its contents, is accepted by the carrier as a single load unit without declaration of value. Therefore, any liability of the carrier for loss of and/or damage to the vehicle shall not exceed the limit set out in Article 423 of the Italian Civil Code, except in the case of liability due to wilful misconduct or gross negligence. Any Passenger wishing to declare the value of the accompanying vehicle must formalise this in writing prior to booking; the cost of transporting the vehicle will depend on the declared value.
10. RULES TO BE OBSERVED BY THE PASSENGER: The passenger is obliged to observe the prescriptions of Italian and foreign laws as well as any regulations of the Company concerning the passage contract. Furthermore, the Passenger is directly liable to the Company for all infringements, harassment, fines and expenses to which, due to his actions, the Company is subjected by the port authorities, customs, health and/or any other authority of any country. It is also agreed that minors must be kept under the supervision of their parents and/or persons in charge and may not circulate on the ship unaccompanied. In the event of an emergency, Passengers must place themselves at the disposal of the Master and Officers and must carry out the orders and prescriptions they receive in a disciplined manner. Passengers are obliged, at their own care, expense and responsibility, to check, prior to embarkation, their documents with the appropriate Police Authorities in order to ascertain that they are suitable for entry into the country of disembarkation. The company will not reimburse Passengers who are not authorised by the border police to embark or disembark because they have been found to have documents that are not suitable for expatriation; the company reserves the right to claim against the Passenger for any costs and/or penalties that it may receive as a consequence of the aforementioned circumstances.
11. HEALTH CONDITIONS OF THE PASSENGER: The Captain has the right to refuse passage to anyone who, in the opinion of the Company, is in such a physical or mental condition that they are unable to undertake the voyage or to anyone who, due to the abuse of drugs, hallucinogens, alcohol, illness or infirmity, is dangerous for the other passengers. In all the aforementioned cases, the Passenger shall not be entitled to compensation for damages and shall be liable for damages caused to the ship, to all its equipment and fittings, to third parties and to third parties' property. The acceptance of the Passenger on board by the Company shall not be considered as a waiver of any of its rights to subsequently assert its reservations on the conditions of the Passenger whether or not these were known to the Company at the time of embarkation and/or departure of the ship. In the event that the aforementioned condition of the Passenger is discovered during navigation, the ship's captain will take the measures required by law.
12. PREGNANT WOMEN: Since ships are not equipped to assist with pregnancy and childbirth, passengers who, on the date of travel, have completed the 24th week of pregnancy cannot be accepted for embarkation. Pregnant passengers who have not completed their 24th week of pregnancy may embark only upon written notification of their condition to the ship and presentation of a medical certificate issued no later than 72 hours prior to departure expressly authorising the trip, which must be presented to the ship's officer. Embarkation implies acceptance by the passenger of the risks connected with the absence on board of assistance (of a specialised type) and facilities suitable for handling any emergencies related to the condition of pregnancy, as well as the specific nature of carriage by sea with consequent difficulty of access to external assistance, with consequent indemnity and exoneration of any and all responsibility on the part of AFH S.p.A. and all its personnel.13. EXPLOSIVES, FLAMMABLE AND HAZARDOUS SUBSTANCES: It is strictly forbidden for the Passenger to include in their baggage or in their belongings stowed on board vehicles industrial residues or explosive and/or flammable substances or otherwise dangerous to the safety of the ship, the cargo or the safety of other Passengers and crew members. In the event of an established breach of this prohibition, the Master is authorised to seize or destroy such substances without the Passenger being entitled to claim any indemnity. The Passenger will also be held responsible for the consequences of the infringement of this prohibition.
14. WEAPONS: Passengers upon embarkation are obliged to hand over in custody to the Captain all weapons and/or firearms in their possession. In case of non-compliance, offenders will be liable to confiscation of the weapons and referral to the competent Judicial Authority.
15. BAGGAGE: The ticket price includes the charge for the carriage of 75 kg of baggage per person: the Passenger may carry hand baggage in the cabin or in the seat assigned. Baggage not handed over to the carrier must contain only items for the Passenger's personal use. All valuables, jewellery, cash, traveller's cheques, etc. may be deposited in the ship's safety deposit boxes or, failing this, handed over in a closed and sealed envelope to the Purser who will issue a receipt for the envelope without checking its contents. If it is ascertained that the baggage not handed over to the Carrier contains objects not for personal use, the Passenger must pay three times the fare for the carriage of such objects in addition to compensation for damages. In any case, it is agreed that the liability of the carrier for baggage and objects not handed over to the carrier is also limited to the maximum amount resulting from any written declaration of value issued by the Passenger, provided that the latter has paid the higher freight. Otherwise, the limit of Art. 412 c.n. shall apply.
16. LOSS AND/OR BREAKAGE OF BAGGAGE AND PERSONAL PROPERTY OR VEHICLE: The loss and/or breakage of the passenger's baggage and other personal belongings or of the vehicle accompanied by the passenger must be reported by the passenger to the Master of the ship or to the agents and/or officers of the Company in the port of disembarkation - under penalty of forfeiture - at the time of delivery if it is an apparent loss or breakage, or within three days of delivery if it is not apparent. For luggage and objects not handed over by the Passenger to the carrier, the latter is not liable for loss and/or damage unless the Passenger proves that such loss and/or damage was caused by a cause attributable to the carrier. In any case, the carrier is not liable for loss and/or damage attributable to acts of vandalism by third parties.17. ACCOMMODATION: The Passenger will occupy the seat indicated in the ticket and if not available the one indicated to him by the Captain or the Purser. The Company, in case of objective necessity, has the right to assign the Passenger to a different seat. In the event that the seat assigned is of a higher type, no difference in fare will be requested, whereas if the new seat is of a lower type, the Passenger will be paid the difference paid in excess, without prejudice to the Passenger's right to terminate the contract in accordance with the law. Cabins must be vacated at least two hours prior to arrival at the port.
18. DOGS AND CATS: The transport of pets, dogs and cats is free of charge. Dogs must be muzzled and are kept in the kennels on board. Cats must be transported in cages. Feeding is the responsibility of the owners. Animals must have a valid international health certificate. Passengers are liable for any damage caused to property or third parties by their animals. The Carrier declines any responsibility for any seizure or suppression of animals by the Sanitary Authorities of the port of disembarkation/embarkation as well as for any damage to animals, for their escape, loss or death occurring during transport or during embarkation and disembarkation, except in the event of proven cases of wilful misconduct and/or fault attributable to the Carrier. However, the Passenger is always required to behave appropriately and diligently in order to avoid and/or prevent such problems.
19. JURISDICTION, APPLICABLE LAW AND COURT OF JURISDICTION: The contract of carriage governed by these General Conditions is subject to Italian jurisdiction and is governed by Italian law. For any dispute concerning the validity, interpretation, execution, termination and extinction of the contract of carriage governed by these General Conditions, as well as for any other aspect and profile connected thereto, the passenger accepts the exclusive jurisdiction of the Court of Ancona.20. INFORMATION ON PASSENGER DATA: Passengers are obliged to provide the following data: name, surname, sex, age, etc. All boarding passengers are required to inform the company of any information relating to their need for special care and/or assistance in emergency situations. Passengers requiring assistance for embarkation (people with mobility difficulties, etc.) are obliged to present themselves for embarkation well in advance, highlighting this need to the dock staff and/or on-board personnel. It is the Passenger's obligation to communicate any changes in personal data if they differ between the time of booking and the time of boarding. Personal data is collected in accordance with Legislative Decree 251/99 implementing EEC Directive 98/41 of 18.06.98, with the regulations relating to the application of the ISPS code on anti-terrorist regulations, as well as in compliance with the provisions of Legislative Decree 196/03.Pursuant to and for the purposes of articles 22 and 23 of Regulation (EU) no. Pursuant to articles 22 and 23 of Regulation (EU) no. 1177/2010 (concerning the rights of passengers travelling by sea and inland waterway), passengers waiting to board Adria Ferries’ motor vessels are informed that the said Regulation can be consulted at the ticket office of the AFH S.p.A. shipping company and on board the vessels.

MOBY General Conditions of Carriage

The following General Conditions of Carriage shall be adequately advertised at all ticket offices, company offices and travel agencies. The term “passenger” is understood to mean any person carried on the basis of these General Conditions for the carriage of passengers and accompanying vehicles. The passenger is obliged to comply with the prescriptions of Italian and foreign laws as well as the regulations of the carrier (both the contracting carrier and the carrier operating the carriage) and the instructions of the ship's Master. When the carrier (contracting and/or actual) is “Moby S.p.A.” for any reports or complaints, it is necessary to fill in the form on the website www.moby.it. 1) RULES OF TRANSPORT The subject of the contract is the carriage of passengers with accompanying vehicles and baggage as governed by these general conditions, by articles 396 et seq. of the Code of Navigation and, as of 31.12.2012, by Regulation EC/392/2009. A summary of the provisions of said regulation on passenger rights is available at www.moby.it and at check-in counters. The carriage of the car is regulated by Italian regulations on the carriage of accompanied baggage (art. 419 et seq. of the Nav. Code) and by these general conditions. Information on passenger rights according to EU regulation 1177/2010 is available on board ships and at check-in counters. Pursuant to Article 19.6 of Regulation EU/1177/2010 the minimum threshold below which compensation is not provided is €6 (six). The indication of the vessel that will perform the carriage is merely indicative as it is possible for the carrier to perform the same with another vessel, even of other carriers. The carrier declines all liability for any damage caused to the passenger by the delay or non-execution of the carriage if the event is the result of unforeseeable circumstances, force majeure, adverse weather conditions, strikes and technical failures constituting force majeure or other causes not attributable to it. It is, however, at the discretion of the ship's Master, in the event of events that may compromise the safety of the ship and/or passengers, to change the itinerary. The offers and conditions advertised may be subject to change up to the time the ticket is issued. For the liability regime in relation to the carriage of passengers, luggage and accompanying cars and for anything not provided for in these general conditions, express reference is made to the current regulations of the Italian Navigation Code. Until disembarkation, passengers are responsible for their hand luggage and its contents. Crossing times are indicative and calculated on the basis of the distance between ports and in favourable weather conditions. The carrier cannot be held responsible for delays due to port operations. 2) VALIDITY OF THE TICKET The ticket is personal, non-transferable and valid only for the carriage specified therein. The passenger is required to keep the contract/ticket in order to justify his right to travel and to show it together with his personal identity document to any ship's Officer or Carrier's Official during check-in operations who may request it. A passenger who is found without a ticket or who cannot prove ownership of the ticket will be required to pay double the passage price, without prejudice to compensation for damages. Upon delivery of the ticket, the customer is required to verify that all data correspond to his or her request and that the data of the accompanying vehicle correspond to what is indicated on the registration certificate and identity document. The carrier assumes no liability for errors or omissions reported later. 3) TOTAL CANCELLATION OF THE TICKET AND REFUNDS Tickets issued at ordinary fares may be refunded provided that the cancellation takes place before the booked departure date, is documented with a validation stamp, date and time by an office of the carrier or an authorised travel agency and transmitted to our Reservation Centre (limited to call centre hours). The original of the cancelled ticket must be returned to the issuing agency. Reimbursement must be requested from the issuing agency and is always subject to the following penalties (the number of days indicated does not include the day of cancellation): ORDINARY-FARE TICKETS: - 10% up to 30 days prior to departure; - 20% from 29 days up to 48 hours prior to departure; - 50% from 48 hours up to 4 hours prior to departure. No refund if cancellation occurs less than 4 hours before departure. For tickets purchased on the same day as the departure date, the cancellation fee is 100%. By purchasing the insurance policy (see information material on www.moby.it) at the same time as the carrier's ticket, if an unforeseen event indicated in the relevant conditions occurs, you may cancel the trip without losing the cost of the penalties. Fees and charges are never refundable. NO refund will be given if - the passenger does not present him/herself at departure; - tickets are cancelled prior to departure. The right to a refund is forfeited if it is not requested by 31 January following the year of the originally scheduled departure. In case of cancellation of a ticket purchased through the use of a bonus previously granted to the passenger, any refund will be made exclusively through the issuance of an additional bonus to be used for the purchase of a new ticket. 4) LOST OR STOLEN TICKETS The loss or theft of a ticket must be reported immediately to the issuing agency or port office of the contracting carrier at the time of departure. A duplicate can only be issued on condition that the original ticket has not already been used, upon presentation of proof of identity. 5) FAILURE TO RECEIVE TICKETS PURCHASED ONLINE Without prejudice to the provisions of article 4 above, in the event of failure to receive a ticket due to causes not attributable to the carrier, including but not limited to the incorrect address details provided by the passenger, the malfunctioning of the passenger's internet or mobile telephone network, computer or telephone terminal, the passenger must promptly notify the Moby Help Desk at helpdesk@moby.it. The duplicate can only be issued on condition that the original ticket has not already been used, after identification of the passenger. 6) VARIATION PENALTIES Variations of date, line, number of passengers, timetable will be accepted, within the limits of the seats and spaces available and on condition that they are requested at least 2 hours before the booked departure (limited to call centre times), subject to payment of €10.00 as reimbursement of expenses for each variation (in addition to payment of any differences), only if indicated on the ticket. A change in destination (e.g. from Corsica to Sardinia) will result in the cancellation of the reservation, with the corresponding penalties, and the reissue of a new ticket. Any fare difference and changes concerning the number of passengers, accompanying vehicles, vehicle categories and accommodation will be refunded at the issuing agency with the following penalties: 10% if made more than 30 days before departure; 20% if made more than 10 days before departure; no refund less than 9 days before departure. The number of days indicated does not include the day of the change and the day of departure. The change is permitted only within the scope of departures published on the carrier's website. The original ticket, prior to the change, must obligatorily be handed over to the agency that changed it. 7) SPECIAL OFFERS - RESTRICTIONS Taking advantage of a special offer entails certain restrictions: - Special offers are available while seats allocated to them last (seats vary according to date and line). - They are valid on all our destinations but only if there is a Best Price fare. - All published offers are valid as of 03/11/2021 and do not include any special offers and extraordinary promotional campaigns that may be proposed by the carrier during the season, which may in any case derogate from the offers and conditions in force at the time of printing without having retroactive effect or giving any entitlement in respect of contracts already concluded. - In principle, special offers cannot be purchased directly at the port on the day of departure but must be booked. - A ticket issued with special offers is changeable for Sardinia and Corsica destinations only on condition that the change is requested at least 2 hours before the booked departure (limited to call centre hours). Each modification involves the payment of a penalty, per route, of €10.00 (Corsica) or €25.00 (Sardinia), in addition to any fare differences. The above penalties shall also be applied in the event of passenger name changes. Notwithstanding the above, for the Island of Elba and for the S. Teresa - Bonifacio and v.v. route, the ticket cannot be changed (not even name changes). - A ticket issued with special offers is not refundable, not even partially, for any route/route. In the event of cancellation, the ticket will be subject to a penalty equal to the total amount paid. This regime automatically extends to all passengers added within the same booking process. - In general, special offers, unless otherwise specified, are never retroactive, nor can they be combined with other discounts or promotions. - Accompanying vehicles covered by the promotions, unless otherwise specified, are always motorbikes and passenger cars (including those registered as trucks) up to 5 m in length and 2.20 m in height. All vehicles - used for transporting goods (with or without cargo) - are not eligible for the sales promotion. In general, vans and pick-ups are not considered cars. - When accessing a promotion involving the booking of an accompanying vehicle, the boarding personnel will ascertain that this vehicle is actually being transported. If the latter is absent, the customer will be required to pay a penalty. - In general, if the port assistance staff discovers anomalies in the booking, with respect to what is present at embarkation, they will request payment of a penalty, even for the outward journey, even if it has already been made. - Penalties generally correspond to the cost of the maximum fare in our price lists. - We recommend the simultaneous purchase of a “travel cancellation policy” (see our website www.moby.it). SPECIAL FARE FOR BORN OR RESIDENT IN SARDINIA In order to take advantage of the special fares for residents and natives of Sardinia, passengers must present, at the time of ticket purchase and upon boarding, a valid personal identification document proving their residence or birth in a Sardinian municipality. In the absence of the indicated documentation, it will not be possible to embark with tickets issued at the “resident or native” fare but it will be necessary to purchase a new ticket at the full fare. The resident or native fare ticket will not be refunded. A ticket issued with a resident fare associated with a special offer is non-refundable. If the native or resident person is making the journey together with his/her spouse, the discount will be granted against self-certification, without the need to provide proof of family status. Non-resident spouses and children travelling in the absence of the native or resident person must accompany the ticket with a self-certification (available at www.moby.it) enclosing the identity document of each applicant and the native or resident Sardinian, without having to show their family status. Non-retroactive offer. For some departures, seats reserved for the resident fare may be limited. SPECIAL FARE FOR ISLAND OF ELBA RESIDENTS OR PIOMBINO RESIDENTS In order to take advantage of the special fares for residents, passengers must show a valid identity document at the time of ticket purchase and boarding, showing residence in a municipality on the Island of Elba or residence in the municipality of Piombino. For accompanied vehicles, the registration certificate must be shown, showing that the vehicle is registered to a person resident on the Island of Elba or in Piombino. The resident fare applies to the resident passenger and vehicle registered in his name. In the absence of the indicated documentation, it will not be possible to board with tickets issued at the resident fare, but it will be necessary to purchase a new full-fare ticket. The resident fare ticket will not be refunded. Offer not retroactive. 8) “TAXES, FEES, CHARGES AND OTHER COSTS” FORFAIT The amounts of the “taxes, fees, charges and other costs” forfait are subject to change up to the time the ticket is issued, except in any case for taxes, fees and changes resulting from changes in the regulations in force. 9) CHECK-IN The time limit for check-in is 30 minutes for passengers without an accompanying vehicle (port of Bastia at least 1 hour in advance), and 1 hour and 30 minutes for passengers with an accompanying vehicle (port of Genoa and Bastia at least 2 hours in advance), except in the case of any provisions issued by the Authorities. Immediately after validating your ticket, you must present yourself for boarding. After this time, the reservation lapses and boarding is no longer guaranteed. For passengers with disabilities or reduced mobility, the provisions of point 17 apply. 10) BOARDING AND DISEMBARKATION OF VEHICLES A) Accompanying vehicles fuelled by liquid gas must be declared at the time of booking and embarkation. B) Alarm and electrical anti-theft systems must be deactivated at the time of embarkation. C) Vehicles used for the carriage of goods must make reservations and are subject to the tariffs laid down for the carriage of goods and therefore do not fall within the category of “accompanied vehicles” as referred to in these conditions. The lengths of accompanying vehicles are to be considered as overall length, including towbars, drawbars or other. Camper vans, caravans, off-road vehicles or any other vehicles that are taller than m. 2.20 from the ground (and/or wider than m. 1.85, although they are not subject to any width surcharge), must be reported at the time of booking. Vans exceeding 6 m in length must be booked by contacting the freight office on 02 57517461. Failure to comply with the above may result in the carrier cancelling the booking and automatically placing you on the waiting list for the day, subject to payment of the difference due in addition to the €50.00 penalty for the outward journey, even if you have already made it. Accompanying vehicles shall not be embarked in the chronological order of their arrival at the quay, but according to the instructions given by the ship's Captain and/or his subordinates and may be accommodated on any of the ship's decks. They must be boarded, parked (with the handbrake on, gear engaged and lights off) and disembarked at the passenger's care and responsibility. Please do not set the alarm but make sure that the doors and luggage compartment are securely closed. The accompanying vehicle, including any trailer or caravan with its contents, is accepted by the carrier as a single load unit. Also pursuant to Article 412 of the Code of Navigation, any damage to the accompanying vehicle or any other damaging event occurring on board ships must be reported before disembarkation. To this end, the passenger must present a report to one of the ship's officers who will make the ascertainment on a special form, which must be signed by the passenger. 11) PREGNANT WOMEN In the case of pregnant women in an uncomplicated gestational state, having completed the 6th month of pregnancy, the passenger must obtain a medical certificate issued no more than seven days prior to departure attesting to her fitness to undertake the sea voyage, which must be presented to the ship's Officer or to the Commissioner who requests it, or to the ship's crew. In the event of pregnancy complications, the passenger must be provided with a medical certificate authorising the trip regardless of the month of gestation. This is without prejudice, however, to the Master's discretion to refuse passage should he consider that the passenger is not fit to undertake the trip. 12) UNACCOMPANIED MINORS Children between 12 and 17 years of age may also travel unaccompanied, under the responsibility of those exercising parental authority. It is necessary to present at boarding, a written declaration, containing all the information indicated on the ticket, in which the parent or those exercising parental authority assume responsibility for the journey made by the minor, enclosing, in addition, the family status and identity document of the undersigned. Children under 12 years of age may not travel alone but must be accompanied at embarkation, disembarkation and during the trip by at least one other adult passenger. If travelling to France, minors must have a valid document for foreign travel. From 28 June 2012, all minors will only be able to travel abroad with an individual travel document; from this date, all minors“ entries on their parents” document are no longer valid. 13) ANIMALS AND PROTECTED SPECIES They will be embarked only if provided with a ticket, rabies vaccination document where required and a valid medical certificate. In compliance with the provisions of the Ministry of Health Order of 27/8/2004 and published in the Official Gazette no. 213 art. 2, we remind you that dog owners must wear a muzzle and keep their dogs on a leash. Pets are not allowed in the cabin except in cabins with pet access or in the armchair lounge. They are only allowed on the outside decks of the ship or, where available, in the appropriate shelters subject to availability. Guide dogs intended to assist the visually impaired, if provided with the appropriate documentation, are exempt from paying the fare. Specimens belonging to protected animal or plant species, in compliance with Art. 727-bis of the Penal Code, implementing Community Directives 92/73/EC and 2009/147/EC, as well as Law no. 150 of 7/2/1992 implementing Council Regulation (EC) no. 338/97 of 9.12.1996, may only be transported if in possession of the relevant licence or certificate and under the conditions stipulated therein. 14) TRANSPORT OF WEAPONS In compliance with the Regulations for maritime navigation Presidential Decree no. 328 of 15/2/1952 Art. 384 - “Passengers, upon embarkation, must hand over the weapons and ammunition in their possession to the ship's captain, who will take care of them until disembarkation. Withdrawal of the arms or ammunition from those who hold them by reason of their office or service is permitted only for serious and ascertained reasons to be indicated in a special declaration at the time of withdrawal.” Failure to report the carrying of weapons is sanctioned under Article 1199, second paragraph of the Code of Navigation, unless it constitutes a more serious offence. 15) INFORMATION ON PASSENGERS In compliance with Decree Law no. 251 of 13/10/1999 implementing EEC Directive 98/41 of 18/06/1998 and with the regulations concerning the application of the ISPS code on anti-terrorist regulations, the following is hereby communicated: all boarding passengers are required to inform the carrier of any information relating to their need for special assistance in emergency situations. All passengers, including minors, must present themselves at the boarding gate with a valid identity document; if not, boarding will be denied. Passengers requiring assistance for embarkation (people with mobility difficulties, etc., whether by car or on foot) must communicate this at the time of booking, contacting the actual carrier's call centre to find out about the availability of suitable accommodation and/or ease of access on board; they are also required to present themselves for embarkation at least 60 minutes in advance, pointing out this need to the quayside and/or on-board staff in order to allow the car to be embarked near suitable access to the ship and possible assistance during embarkation and disembarkation operations. Passengers are also required to communicate their personal details at the time of booking, understood as: SURNAME, NAME, SEX, NATIONALITY, AGE CATEGORY (infant, child, adult and infant), DATE AND PLACE OF BIRTH. In the event of a change in the data highlighted above between the time of booking and the time of boarding, passengers are obliged to communicate these changes. Personal data, collected in accordance with this article, are kept only for the time necessary for the purposes of the aforementioned decree and/or in compliance with the provisions of Legislative Decree No. 196/2003. Please note that for departures from Italy to France or vice versa, a valid document for foreign travel (passport or identity card, even for minors) is required upon boarding. From 28 June 2012, all minors will only be able to travel abroad with an individual travel document; from this date, all minors' entries on their parents' document are no longer valid. For Corsica, passengers must be in possession of documents valid for foreign travel. 16) PASSENGER'S HEALTH CONDITIONS The on-board doctor, where present, provides assistance only in cases of emergency; the carrier does not, therefore, accept passengers requiring medical assistance during transport, except as provided for in point 17 below. In the presence of a suitable medical certificate issued no more than 48 hours before departure and issued by a public health facility (hospital, ASL), stating that the passenger does not require medical assistance during carriage, the carrier will embark said passenger, declining all liability in this regard. It is also subject to the judgement of the captain and the on-board doctor, if any, to board a passenger who is in such a physical or mental condition that he/she is unable to undertake the journey or is in such a condition as to cause discomfort or danger to him/herself or others due to the abuse of drugs, hallucinogens and alcohol. In all of the aforementioned cases, the passenger shall not be entitled to compensation for damages and shall be liable for damages caused to his or her person, the ship, all of its fittings or equipment, third parties as well as third parties' property. The acceptance of the passenger on board by the carrier shall not be considered as a waiver of any right of the carrier to enforce its reservations about the passenger's condition, whether or not known to the carrier at the time of embarkation and/or departure of the vessel. 17) PEOPLE WITH DISABILITIES AND PEOPLE WITH REDUCED MOBILITY The carrier accepts reservations from disabled persons and persons with reduced mobility under the same conditions applicable to all other passengers, subject however to the provisions of Regulation EU/1177/2010 (a notice regarding this regulation is available at www.moby.it). Disabled persons or persons with reduced mobility must notify the carrier at the time of reservation or advance purchase of the ticket of their specific needs with regard to accommodation, seating, required services or the need to carry medical equipment provided such needs or requirements are known at that time. The notification may be sent to the travel agent or the tour operator from which the ticket was purchased. The Carrier will provide the passenger with the necessary information regarding the conditions of access and assistance on board, including the times of presentation at the port of departure. If strictly necessary, the Carrier may require that a disabled adult person or an adult person with reduced mobility be accompanied by another person (accompanying person) capable of providing the necessary assistance to the disabled person or person with reduced mobility. Such an accompanying person shall be transported free of charge. Where a disabled person or person with reduced mobility is accompanied by a recognised assistance dog, that dog shall be accommodated together with that person, provided that the Carrier is notified in accordance with applicable national rules on the carriage of recognised assistance dogs on board passenger ships. The Carrier may refuse to accept a reservation from, to issue a ticket to or to embark a disabled person or person with reduced mobility for the purpose of complying with applicable safety requirements established by international, European Union or national legislation or for the purpose of complying with safety requirements established by the competent authorities; or where the design of the ship or port infrastructure and equipment makes it impossible to carry out the embarkation, disembarkation or carriage of that person in a safe or operationally feasible manner; in such a case, the disabled person or person with reduced mobility shall be notified immediately of the specific reasons. Upon request, those reasons shall be notified in writing to the disabled person or person with reduced mobility no later than five days after the request. If the disabled person or person with reduced mobility, who holds a reservation or ticket and has been duly notified, is nonetheless denied embarkation, that person and any accompanying person shall be offered the choice between the right to reimbursement and re-routing, subject to all safety requirements being met. The carrier is liable for damage resulting from the loss of or damage to mobility equipment or other specific equipment used by disabled persons or persons with reduced mobility if the incident which caused the damage was due to the fault or neglect of the carrier or the terminal operator. The fault or neglect of the carrier shall be presumed when the damage was caused by a shipping incident. The compensation referred to in paragraph 1 shall correspond to the replacement value of the equipment concerned or, where applicable, to the costs of repair. These provisions shall not apply where Article 4 of Regulation (EC) No 392/2009 applies. Disabled passengers or passengers with reduced mobility who also require boarding assistance must inform the Carrier at least 48 hours in advance of their needs and present themselves at least 60 minutes before the departure time. 18) BOARDING INFORMATION AND NAVIGATION REGULATIONS Passengers upon boarding are required to take all valuables and anything else they may need during the crossing from the accompanying car (all ships are air-conditioned). The carrier is not liable for any missing items and/or equipment from the car. It is strictly forbidden to disembark from the ship after embarkation. If the ship is equipped with a side entrance for foot passengers, access to the garage with the car is allowed only to the driver, the other passengers must use the side staircase with the nominal check-in coupon.It is absolutely forbidden to enter the ship's garage during navigation. 19) ACCOMMODATION At the time of embarkation it is essential to present yourself at the Reception desk on board for cabin or seat assignment. Failing this, the same will be put up for sale 1 hour and 30 minutes after the departure of the ship. Cabins must be vacated at least one hour before arrival in port. 20) SECURITY INFORMATION AND ISPS COSTS In compliance with the international ISPS code concerning anti-terrorist regulations, passengers are informed that they are required to show their travel ticket and identity document if requested by a ship's officer or other security personnel. They are also required to consent to any inspection of their baggage or vehicle if requested to do so. Such inspections may also be carried out by port facilities. Please note that while ships are in port, it is forbidden to come within 50 metres of the ship and its moorings. Furthermore, in connection with the application of the ISPS code, the carrier informs you that the port authorities may have further requests and the payment of additional fees, not yet quantified at the time of printing this brochure. In the ports of Bastia, Bonifacio and Nice, passengers without accompanying vehicles cannot embark: - Category A weapons (firearms, bombs, laser beam weapons, etc.) - Propane/Elium - LPG - Diesel fuel - Fire extinguisher - Diving equipment - Fireworks. Passengers with accompanying vehicles are not allowed to embark: - Category A weapons (Firearms, bomb, laser beam weapons, ...). 21) VEHICLE PLATES According to current regulations, the Authorities oblige shipping companies to provide the identification number of the licence plate of all accompanying vehicles carried: passengers with accompanying vehicles are therefore obliged to provide such data to the shipping company. This regulation does not apply to journeys to and from the Island of Elba. 22) LOST OBJECTS Should passengers forget or lose personal items on board, they may contact the ship's reception desk or, once disembarked, they may fill in the appropriate form which can be downloaded from the actual carrier's website (which, in the case of Moby is www.moby.it) and send it to the relevant e-mail address (for Moby: oggetti.smarriti@moby.it). The carrier, as soon as it receives the report, will immediately carry out all necessary searches, without being liable for any compensation in the event of failure to find the objects forgotten or lost on board by the passenger. Items found and mailed will be stored for 6 months. 23) LIABILITY OF THE ACTUAL CARRIER If the maritime carrier operating the carriage is not the contracting carrier, the actual carrier assumes liability for the carriage in accordance with Article 1681 of the Civil Code and Regulation EC/392/2009, so the passenger has the right to take direct action against it. The indication of the actual carrier, if different from the contracting carrier, may take place from the moment of pre-notation in which case it shall be indicated on the ticket or by notification within 24 hours of departure. 24) APPLICABLE LAW AND COURT OF JURISDICTION The contract of carriage of passengers, luggage and accompanying vehicles is governed, except as provided for in these general conditions, by Italian law, and is interpreted in accordance with the same. For any dispute arising from the interpretation and/or execution of this contract the competent court of jurisdiction is exclusively that of the registered office of the carrier. In the case of a passenger who qualifies as a consumer under current Italian law, the court of residence or domicile of the same shall have exclusive jurisdiction, provided that the consumer is resident or domiciled in a Member State of the European Union. 25) GROUP RATES There are special rates for groups, for information contact the call centre or travel agencies. 26) CARRIAGE OF GOODS Moby offices are available for any information, quotations and bookings concerning the carriage of goods (Call Centre Merci 02 57517461). The following are the general conditions of carriage of the company in question.

GENERAL CONDITIONS

The Company is not in fault if the passenger with open date ticket does not book in advance for his travel. According to EU Directive 98/41 passengers must provide their details for the passenger registration system. Passengers with special needs must declare this at the time of the reservation. Passengers arriving at check in without the original ticket may be refused the travel by the Company. Cancellation fees apply as follows (excluding tickets purchased with special offers under which they may be non-refundable) :
  • Cancellation up to 30days before departure: 100% refund
  • Cancellation from 29days till 7 days before departure: 75% refund
  • Cancellation from 6 days till 24hours before departure: 50% refund
  • For non-show tickets there is no refund
11. The refund is only made by the agency that has issued the ticket.12. Early booking offers tickets are not refundable.Passengers must be present for check-in minimum 2 hours before the departure time. This reduction is only applicable if the return ticket is issued together with the outbound ticket at the time of purchase. The return discount is applied regardless of the port chosen. ATTENTION: discounts cannot be combined.EmbarkationPassengers with reservations must present themselves at the port offices at least two hours before the departure of the ship. The ceck-in closes 20 minutes before departure. The company has the right to cancel the booking after the ceck-in has closed; in this case no refund is due. FOREWORD
In the following text, the following words mean:
  • - Company: SIREMAR - COMPAGNIA DELLE ISOLE S.P.A. Calata Marinai d'Italia - 90139 Palermo c.f.: 05989930820
  • - Vehicle: any vehicle, including cars, motorbikes, caravans, trolleys, camper vans, trucks, etc., for private or public use, used for the transport of persons or goods, travelling with the passenger.
  • - Passenger: any person on board the vessel who is not the master, a member of the crew, or any other person employed or engaged in any capacity on board the vessel for the purpose of its services.
  • - Ticket: travel document proving the conclusion of the transport contract or passage ticket pursuant to Article 396 of the Navigation Code.
  • - Tariff: set of tariffs in force, applied by the Company and approved by the competent Ministry.

Art. 1

ASSUMPTION OF SERVICE
The Company assumes the carriage of passengers, luggage and accompanying vehicles in accordance with the following regulations that the passenger, by purchasing the ticket, implicitly declares to know, accept and observe. The extract of the conditions governing the carriage on the Company's ships and fast vehicles is printed on the ticket. The text of these regulations is available to users at the Company's offices and agents and at the Commands on board.

Art. 2

TICKET AMOUNT
The total amount of the ticket consists of the fare plus any other fees shown separately. The fares applied by the Company include VAT when due. For fares, please refer to the Company's “schedule of fares”, which forms an integral part of these regulations.

Art. 3

CHILDREN AND YOUNG PEOPLE
Children under the age of 12 must be accompanied by adult passengers. Please refer to the price list for reductions applied according to age.

Art. 4

TRAVEL FACILITIES
The Company grants travel facilitations in the cases provided for in the tariff schedule. The facilities established in favour of those who are entitled to them are applicable to fares excluding, therefore, all accessories. Passengers who are entitled to more than one facilitation will only be granted the most favourable one, as no accumulation of the same is permitted. Passengers benefiting from the facilities must be in possession of the document that entitles them to the facility and are required to show it, upon request, to the on-board staff and/or to the Company's representatives. Those who are not in possession of the said document will be required to pay the difference between the full fare and the reduced fare they have been entitled to, plus the right to collect the fare on board as provided by the fare schedule.

Art. 5

TICKETS
In order to travel on the Company's ships and fast vehicles, the passenger must be in possession of a regular ticket, which is proof of the conclusion of the contract for the journey indicated on the ticket. This ticket must be retained for the duration of the journey and presented at the request of the Company's control personnel. Those who are found during a control by the Company's staff to be without a regular ticket will be required to pay the full price of the ticket plus the on-board collection fee stipulated in the fare schedule. Any vehicle found to be without a ticket or to be using a facilitation without having the right to do so, or which is ticketed for a lower class or length, shall be required to pay the difference with the ordinary fare plus the right to collect on board. Both one-way and return tickets are valid only for the departures indicated on them. In the event of loss, destruction or theft of the ticket, a new ticket must be purchased in order to gain access on board. Tickets may exceptionally be requested on board ferries and high-speed vessels, in which case the on-board collection fee stipulated in the fare schedule shall be due in addition to the passage price. No concessions other than those provided for residents apply to tickets issued on board; those entitled to other concessions and/or reductions must apply to the Company's offices for the difference between the fare applied and that to which they are entitled.

Art. 6

RESERVATIONS
Requests for reservations of seats and/or garage spaces can be made in good time before departure at the Company's ticket offices at ports of embarkation, at authorised travel agencies and possibly through other channels advertised by the Company from time to time. Requests for reservation and/or purchase of tickets must specify the date and time of departure, port of embarkation, port of destination, number of passengers, type of vehicle, as well as provide any other useful information for identifying the applicant(s) and the correct application of the fares. For each seat and/or garage space booked when the ticket is issued, a reservation fee is due at the rate set out in the price list. The mere reservation request, the reservation of which has not been previously confirmed through the purchase of the ticket, does not bind the Company in any way, which shall not be liable for any lack of seats and/or garage spaces.

Art. 7

EMBARKATION - DISEMBARKATION - STAY ON BOARD
Passengers with accompanying vehicles, if any, are required to present themselves at the embarkation point, with a valid ticket, at least thirty minutes before the departure of the ship or fast means of transport; after this time, embarkation will not be guaranteed. 2nd paragraph - Repealed. Embarkation and disembarkation of vehicles accompanying passengers shall be carried out by the passenger himself. Embarking and disembarking operations take place according to the order and criteria established from time to time by the on-board Command. Embarkation of the vehicle is subordinate not only to the performance of the voyage, but also to the requirements of the ship and any other requirements in any case connected to the navigability of the ship and the safety of navigation. All this at the unquestionable judgement of the Command as provided for by the regulations on the subject, even in the event that an agreement regarding “space reservation” (booking) has been made between the passenger and the Company. The boarding, stay on board and disembarkation of passengers and vehicles are governed by the law, by the provisions issued by the ship's Command in relation to particular situations, as well as by the following provisions:
  • a. except as provided for in the second paragraph of art. 192 of the Navigation Code, the embarkation of passengers manifestly suffering from serious diseases or, in any case, dangerous for the safety of navigation, and for the safety of the persons on board, is subject to the authorisations given by the competent Health Authorities;
  • b. even if there is no danger to the safety of navigation and the safety of persons on board, for the embarkation of passengers who are manifestly in such a physical condition as to make sea voyages inadvisable, medical certification authorising the voyage shall be required in the interest of the passengers themselves;
  • c. no passengers in an obvious state of agitation or in an obvious and harassing state of drunkenness will be allowed on board;
  • d. it is compulsory to use for maritime transport in relation to the peculiarities of such transport, vehicles that are efficient in every part, especially with regard to the braking, rolling, suspension and, where applicable, lashing parts;
  • e. it is compulsory to present vehicles for embarkation with the cargo packed, arranged and rigged in a workmanlike manner and with the arrangements and any storage systems required by the type of goods and the type of vehicle, all in accordance with criteria suitable for transport by sea;
  • f. is compulsory for drivers of accompanying vehicles:
  • - Engage a low gear and fully apply the parking brake;
  • - remove the keys from the dashboard and switch off all electrical equipment;
  • - switch off the alarm system;
  • - for motor homes and caravans, close all gas shutoff valves and switch off electrical equipment;
  • - the state in which the vehicle is left must comply with the rules laid down by the Maritime Authority.
  • g. it is compulsory to declare the carriage of vehicles fuelled by LPG/methane or other gases to the ship's command before embarkation.
The carriage of refrigerated vehicles is subject to the rules of RINA (Italian Naval Registry), as well as to the regulations issued on the matter by the competent authority, rules that prohibit the use of energy sources on board the vehicles themselves. The Company reserves the right, at the request of the passenger, with whom the vehicle is travelling, and within the limits of the ship's availability, to supply on-board electrical energy, provided that the vehicles are equipped with the special explosion-proof plug. In the case of the supply of electricity on board, any interruption in the supply of said energy by the ship for any reason or cause whatsoever, none excluded and excepted, or variations in voltage, does not entail responsibility for the Command and, on its behalf, for the Company, as the passenger acknowledges that the connection with the on-board system takes place at his/her own risk and, under his/her responsibility, also in relation to third parties. The supply of energy may also be suspended by the Command on board in the event that the engine of the refrigerated vehicle is not, in the opinion of said Command, functioning properly and does not offer adequate guarantees of safety for the cargo and the ship. For their own safety, passengers are required to comply with the safety instructions given by signs, audio messages as well as directly communicated by the ship's personnel.

Art. 8

LUGGAGE
Each passenger is entitled to carry 20 kg gross of hand luggage free of charge when travelling on ferries and 10 kg when travelling on high-speed vessels. Children paying half fare are granted half of the allowance, i.e. 10 kg. in the case of ferries and 5 in the case of high-speed vessels. Belongings which, for the passenger's personal use, are routinely transported in suitcases, travel bags, boxes and the like are considered and accepted as baggage. If other items are included in baggage, the passenger owes double the fare for the carriage of such items, plus compensation for damages. Commercial travellers' samples up to a limit of 20 kg are also allowed as baggage. The Company declines all liability for the theft of objects and/or luggage left unattended. With regard to the liability of the Company, the regulations set forth in Articles 411 and 412 of the Navigation Code are applicable.

Art. 9

LEGAL LIEN ON LUGGAGE
The Company has a legal lien on the baggage for claims against the passenger arising from the contract of carriage. When the passenger fulfils his obligations, the Company is obliged to deliver the luggage to the place determined by the contract. If the passenger does not fulfil his obligations, pursuant to Article 416 of the Navigation Code, the Company has the right to proceed with the sale of the baggage in accordance with the relevant provisions of the Civil Code (Articles 1515, 2797 of the Civil Code and 83 of its implementing provisions).

Art. 10

ANIMALS
Unless otherwise prescribed by law, the carriage of dogs, cats and other small live animals is permitted accompanying passengers. Dogs must be leashed and muzzled, other small animals must be placed in cages or baskets, which are the responsibility of the passenger. Passengers accompanying animals must stay in the specially reserved areas or place the animals in the kennels on board, if the vessel is equipped with them. Exceptions are guide dogs for the blind. The transport of pets and their maintenance are the responsibility of their owners. The carriage of pets accompanying passengers is also governed by the relevant health regulations of the competent authorities. The passenger undertakes to indemnify the Company from any liability and burden that may be incurred by the Company as a consequence or effect of his/her failure to comply with the aforementioned regulations, as well as with the laws on the subject. The Company shall not be liable for losses that may occur to domestic animals if the event is due to a cause not attributable to it. Other animals may only be transported on ferries using special, duly approved vehicles and on journeys and times agreed in advance with the Company.

Art. 11

DANGEROUS GOODS
The carriage of inflammable, explosive, corrosive and dangerous materials in commercial vehicles is permitted on vessels that are licensed for such carriage and, within the limits of the licence, in compliance with the regulations in force. Passengers are obliged to declare the existence of dangerous goods to the Company prior to embarkation, which must be presented for embarkation in the conditions prescribed by law. The transports referred to in this article must, in any case, be announced to the Company and to the agent at the port of embarkation at least three working days in advance.

Art. 12

COLLECTION OF VEHICLES AND LUGGAGE
Upon arrival of the ship, passengers shall promptly collect their vehicles. Under no circumstances shall the passenger have the right to abandon the loaded vehicles to the Company, even if damaged or otherwise depreciated. If the passenger fails to disembark the vehicle and it remains on board, the relevant freight shall be charged to the passenger. No claim for compensation, loss or other damage suffered by luggage or accompanying vehicles shall be admitted if the state of the same is not acknowledged upon arrival in contradiction with the on-board Command and is not evidenced by a regular report.

Article 13

PROHIBITIONS
It is absolutely forbidden to:
  • a. engage in behaviour or attitudes that are or may be a cause of disturbance or annoyance to other passengers;
  • b. exercise the profession of salesman, singer, musician and the like on board and offer services or accompaniment to passengers;
  • c. bring animals or things into the lounges that may disturb passengers or that are contrary to the rules of hygiene and decorum, except for the exception provided for in the third paragraph of Article 10;
  • d. lying on sofas;
  • e. smoking in the interior areas of the ship;
  • f. opening and closing portholes and windows, as well as tampering with furnishings and equipment on board, for all of the above, passengers must refer exclusively to the ship's personnel;
  • g. wear or keep in their luggage arms and ammunition, which must be handed over to the ship's Command at embarkation and will only be collected upon disembarkation, subject to the provisions in force governing the carrying of arms for Armed Forces and Police Force personnel;
  • h. to carry flammable, explosive, corrosive, or otherwise dangerous materials, as well as cylinders filled with oxygen, compressed air, gas and the like, in baggage or inside the accompanying vehicles;
  • i. transporting letters and parcels subject to postal charges;
  • j. throwing objects of any kind into the sea;
  • k. stopping inside the vehicle during the crossing;
  • l. start the engine before the landing ramps have been fully opened.

Article 14

IMPEDIMENT OF NAUTICAL MEANS - CANCELLATION OF DEPARTURE - CHANGE OF ITINERARY - DELAY OF DEPARTURE - ANTICIPATION OF DEPARTURE DUE TO FORCE MAJEURE - INTERRUPTION OF VOYAGE
If the departure of the ship or fast craft is prevented for reasons not attributable to the Company, the contract is terminated and the Company is obliged to refund the price paid to it. (art.402 Navigation Code) Notwithstanding the interconnection existing between the various traffic relations exercised by the Company, the regulations of articles 403,404,405 and 406 of the Navigation Code are applicable.

Art. 15

PASSENGER'S IMPEDIMENT - MISSED DEPARTURE AND INTERRUPTION OF PASSENGER'S JOURNEY - REIMBURSEMENT
Cancellation of the journey must be communicated by the passenger in the following ways: - up to two hours before departure, at any of the travel agencies authorised by the Company to sell tickets, or at the ticket counters of the airports; - up to 30 minutes before departure, at the ticket counter of the embarking airport. In this case, the contract is terminated and the passenger is required to reimburse the ticket with the application of penalties determined in the following percentages: - 10% for passes cancelled up to the day before departure, - 25% for passes cancelled on the day of departure and up to 30 minutes before departure. Booking fees are never refundable. The possibility of communicating the cancellation to parties other than those indicated above will be set out in the illustrative material distributed by the Company. The right to reimbursement for journeys cancelled within the aforementioned terms shall expire - in any case - six months after the departure date indicated on the ticket. No refund is due for journeys not cancelled within the aforementioned terms. If the passenger is forced to interrupt the journey for reasons not attributable to him, the fare is due in proportion to the part of the journey that has been usefully made. If the trip is interrupted due to the passenger's fault, the Company is not obliged to refund the difference in the passage price relative to the unused section (Article 406 of the Navigation Code).

Art. 16

LIABILITY
The Master is a judicial police officer and, in this capacity, exercises the powers referred to in Articles 221 et seq. of the Code of Criminal Procedure, in the event that offences are committed on board during navigation, and exercises his authority over all persons on board (crew and passengers). He has disciplinary and navigational safety police powers. Passengers, from the moment of embarkation until disembarkation, must comply with the instructions given by the ship's Captain; they must also behave with common diligence and prudence, keeping watch over the safety and security of themselves, of the persons and animals in their care, as well as the safety of their belongings, and this when the weather and sea conditions of the voyage require it. The Company is liable for accidents to passengers that occur from the beginning of embarkation until the completion of disembarkation, and for the loss or damage of the things that the traveller brings with him/her if he/she does not prove that the events have resulted from causes not attributable to him/her. This is without prejudice to cases in which the event derives from causes not attributable to the Company itself, from the passenger's failure to comply with the prescriptions established by the Command of the ship for the safeguard of human life at sea. The Company shall in no case be liable for loss or damage caused to the vehicles embarked or to the things contained therein by any other vehicle. Any claims shall be settled directly between the parties involved.

Art. 17

PRESCRIPTION
Claims arising from the contract of carriage of persons and their accompanying baggage are time-barred in accordance with the terms provided for in Article 418 of the Navigation Code. In any case, without prejudice to the terms provided for in the preceding paragraph of this article, a passenger who suffers accidents to his or her person due to facts occurring at the beginning of embarkation until the completion of disembarkation, must in any case report them to the Master on board before final disembarkation.

Art. 18

COMPLAINTS
If the passenger notices shortcomings or irregularities in the service rendered by the Company, he/she may report them to the on-board Command or to the Company Management.

Art. 19

Pursuant to Article 13 of Legislative Decree no. 196 of 30.06.2003, containing provisions on the protection of personal data, the Company, in its capacity as data controller, hereby informs you that the personal data provided by passengers will be processed for purposes strictly related to the management of the contractual relationship and the provision of services, including by means of information systems suitable to guarantee their security and confidentiality

Art. 20

COMPETENT COURT
Repealed.

Article 21

POSTPONEMENT
For all other matters not covered by these conditions of carriage, the provisions of the Code of Navigation, the Civil Code and other applicable legal provisions shall apply.

SNAV General Conditions

The following are the general conditions of carriage of the company in question.


GENERAL CONDITIONS
Art. 1 Generalities
- The object of this contract is transport as governed by articles 396 et seq. of the Code of Navigation. The indication of the vessel that will perform the carriage is merely indicative, as substitution with another vessel is possible. The carrier is not liable for damage caused by delay or non-execution or inexact execution of the carriage if the event is the result of a fortuitous event, force majeure, adverse weather and sea conditions, strikes and technical failures constituting force majeure or other causes not attributable to it. In the event of events that may jeopardise the safety of the vessel and/or passengers, the Master of the vessel has the right to change the itinerary. The advertised fares and conditions may be subject to change until the ticket is issued. For anything not provided for in these conditions regarding the liability regime in relation to the carriage of passengers and cars, express reference is made to the current regulations of the Code of Navigation. Until disembarkation, passengers are responsible for their luggage and its contents. Crossing times are calculated on the basis of the distance between ports in favourable weather and sea conditions. The Company cannot be held responsible for delays due to port operations.
Art. 2 Ticket
- The passage ticket is personal, non-transferable and valid only for the carriage specified therein. The passenger is obliged to keep the contract/ticket in order to justify his/her right to travel and to show it to any Officer of the ship or Officer of the Company who may request it. A passenger found without a ticket shall be required to pay double the passage price, without prejudice to compensation for damages.
Art. 3 Lost or stolen tickets
- In the event of theft, loss or misplacement of the ticket, the passenger is obliged to report it to the Police and promptly inform the Company. The passenger shall deliver to the Company's Office or Agency a copy of the report submitted to the competent authority and pay the price of a new ticket. If the lost/stolen ticket is not used within six months of the departure date indicated on it, the Company shall refund the price originally paid by the passenger.
Art. 4 Presentation for embarkation

- In application of international security regulations (ISPS Code), check-in operations must be completed at least two hours before the departure time at the SNAV ticket office. After this deadline, boarding is not guaranteed. Passengers must ensure, before departure, that there are no changes to the departure time shown on the ticket.

Art. 5 Vehicle embarkation and disembarkation
- For safety reasons, it is prohibited to transport vehicles carrying dangerous or harmful goods that are not permitted under current regulations and containers containing flammable products. Vehicles powered by liquid gas must be declared when booking and boarding. Vehicle lengths are to be considered overall, including towbars, drawbars or other. Camper vans, caravans, all-terrain vehicles or any other vehicles exceeding 1.80 metres in height from the ground and/or width exceeding 1.85 metres must be declared at the time of booking. Failure to comply with the above may result in the cancellation of the booking. Vehicles are embarked in the order ordered by the On-board Command. Vehicles are embarked, parked (with the handbrake pulled, gear engaged, alarm and electrical anti-theft systems disengaged, windows closed, locks open and the contact key hanging from the dashboard) and disembarked at the passenger's care and responsibility. The Company is liable for the loss of and damage to the vehicle accompanying the passenger within the limits set forth in articles 422 and 423 of the navigation code.
Art. 6 Luggage
- The price of passage includes the fee for the carriage of the passenger's hand luggage up to a limit of 10 kg per passenger. The price of passage does not include the fee for any luggage services. Baggage may only contain personal items of the passenger ordinarily carried in suitcases, travel bags, boxes, crates and the like. Commercial travellers' samples are allowed as baggage, subject to the obligation of those concerned to take care of any customs requirements. Each passenger may take his or her own baggage into the cabin or assigned seat. For baggage in excess of the 10 kg limit, current fares will apply. If, due to its size, it is not possible to place such baggage in the cabin or in the assigned seat, the passenger must deposit it in the ship's baggage compartment. In this case, the Company will fill out, in duplicate, one of which will be given to the passenger, a slip indicating the place and date of issue, the place of departure and the place of destination, the passenger's name and domicile, the number and weight of the packages, the declared value, if any, and the price of carriage. Passengers may deposit valuables, valuables or money free of charge at the Purser's office as long as they are not bulky in nature.
Article 7 Baggage Insurance
- The Company is liable for loss of and damage to baggage within the limits provided by Article 412 of the Navigation Code. However, when the baggage is delivered on board the Company's vessels, the passenger has the option of indicating the value of the baggage, if any. In this case, the Company may request an amount from the passenger as consideration for insurance coverage in favour of the passenger.
Art. 8 Passenger reports
- If the passenger reveals shortcomings and/or irregularities regarding the service rendered by the Company, he/she may notify the Ship's Command and the Company's Management. The passenger is also entitled to note his/her findings in the “Book of praise and complaints” available on board the Units.
Art. 9 Passenger information
- In compliance with the Ministerial Decree of 13 October 1999 and the regulations relating to the application of the ISPS Code on anti-terrorist regulations, all passengers are required to communicate to the Company, among other things, their last name, first name, gender, age category (infant, child, adult) or age or year of birth as well as, at the passenger's request, information relating to their need for special care and/or assistance in emergency situations.
Art. 10 Documents valid for travel abroad
- Passengers, including minors, must have a passport or other document valid for travel abroad and, if required, visas and vaccination certificates.
Art. 11 Animals
- Unless otherwise prescribed by law, the carriage of pets is permitted in the designated spaces on board, provided they have a valid ticket and vaccination document. The care of pets is the responsibility of the passenger. In accordance with the Ministry of Health Order of 27 August 2004, dog owners are obliged to muzzle and leash their dogs in public places and on means of transport.
Art. 12 Cancellation, delay and interruption of travel
- The cancellation, delayed departure and interruption of the voyage are governed by Articles 403, 404 and 405 of the Shipping Code respectively. Arrival times, where foreseen, are to be understood as indicative and may be subject to variations as a result of weather and sea conditions, port traffic, limitations imposed by the competent authorities or other entities not attributable to the Company.
Article 13 -Refunds
- The contract, once concluded, cannot be terminated by the contracting parties. Snav, however, by way of derogation from art. 400 of the Navigation Code, grants passengers who do not intend to or can no longer depart the right to obtain a refund of part of the passage price. The refund will be 80% of the ticket price if the passenger's written communication is received at least 48 hours before the departure date and 50% if the written communication is received between 48 hours and 4 hours before departure. Tickets issued with special fares are non-refundable. Name tickets are non-transferable. All tickets are valid exclusively for the date, route and time indicated on them. Notwithstanding the above, Snav grants passengers the right to change the passenger's name and insurance policy where taken out, as well as the date, route and/or time, subject to verification of seat availability and payment by the passenger of the amount of € 10.00. In the event that, as a result of the changes, there is a difference in price between the original ticket and the replacement ticket, the passenger, depending on the case, shall have the right to obtain or the obligation to pay said difference. The original ticket, prior to the change, shall be handed over to the agency/ticket office that will provide the replacement.
Article 14 - Special Tariffs
- All special and/or promotional fares are available while seats last and are automatically proposed by the various booking systems. Unless otherwise stated, special fares cannot be combined with other promotional fares. Happy Price application: The application of the “Happy Price” fare varies according to the date and time of departure, the number of passengers, the accommodation chosen and is subject to seat availability at the time of booking.
Art. 15 Fuel surcharge, port taxes and fees
- The fares in force are net of surcharges due to possible increases in the cost of fuel, taxes and port fees, the amounts of which are subject to change until the ticket is issued. The following sales charges apply to the ticket price: Call Centre and stopover ticket offices Euro 4.00 Internet Euro 1.50 Other systems Euro 3.00
Art. 16 Security Information and ISPS Costs
- In compliance with the provisions of the ISPS international code on anti-terrorist regulations, passengers are required to show their passage ticket and identity document if requested by a ship's officer. They are also required to consent to any inspection of their baggage if requested. Such inspections may also be carried out by port facilities. Please note that while ships are in port, it is forbidden to come within 50 metres of the ship and its moorings. Furthermore, the Company would like to inform you that the port authorities may order additional requests and the payment of additional fees that have not yet been quantified.
Art. 17 Prescription
- Claims arising from the contract of carriage of persons, luggage and vehicles shall be barred by the lapse of the periods provided for in Articles 418 and 438 of the Code de la Navigation.
Art. 18 Applicable Law and Jurisdiction
- This contract is governed by and construed in accordance with Italian law. The court of jurisdiction for any dispute shall be the court of the place where the Company has its registered office. However, in the case of a passenger resident in Italy who qualifies as a consumer under current Italian law, the court of residence or domicile of the same shall have jurisdiction.

General conditions of carriage NLG

Below are the company's general conditions of carriage:


Navigazione Libera del Golfo S.r.l., hereinafter referred to as “the Company”, undertakes the carriage of persons, their luggage, vehicles and motorbikes accompanying passengers, in accordance with these Regulations of Carriage, the conditions of which are considered fully known and accepted by anyone who purchases or uses tickets for passage by the Company. The Transport Regulations are available to users at the Company's offices and ticket offices, as well as at the Commands on board. The fares, timetables, routes and other conditions stated herein may be changed over time.
1) TICKETS AND FARES
- The passage ticket is personal and non-transferable, and is valid only for the carriage specified on it. The passenger is obliged to diligently guard the ticket to justify his or her right to travel, and to show it to any Ship's Officer or Company Official who requests it. Tickets bearing abrasions and/or corrections are considered void. Tickets not used for the date and the journey will lose their validity, with no right to reimbursement. The regulations and fares in force can be consulted at the Company's ticket offices and on board the vessels. Duplicates will not be issued for lost or stolen tickets.
Online tickets
- Tickets issued on-line follow the specific regulations, explained in the area of the company's website dedicated to the purchase of this type of ticket.
Children
Children under 2 years of age are granted free passage without the right to a seat; if they occupy a seat, payment of the prescribed fare is due. Children between 2 and 12 years of age pay the child fare. From 12 years of age they pay full fare. The age of the children must be documented before the ticket is issued. Children under 12 years of age must be kept under the supervision of parents and/or adults who have custody of them and may not travel on the ship unaccompanied. The Company shall not be liable for damages incurred by minors in the event of failure to comply with the above.
Reductions
Reductions in passage prices must be requested by those entitled to them before the ticket is issued, and upon presentation of supporting documents.
Reductions for island residents
Concessionary fares for island residents - on the routes where they are provided - are only applicable to passengers who prove their residence on the island, with proper documentation. Passengers who, during the journey, are found without the document entitling them to the concessionary fare applied when the ticket was issued, will be required to pay the difference between the reduced fare already paid and the full fare, increased by 100%.
On-board checks
The Company, by means of inspectors in charge of control or even its own on-board staff, may carry out checks on tickets even during navigation. Passengers who are found to be missing, without having given prior notice to the Captain or the on-board staff, will be subject to payment of the full fare, increased by 100%.
2) BOOKINGS
- Seats booked by specially authorised Travel Agencies, without simultaneous purchase of a ticket, remain available to the booker until one hour prior to departure. After this time, if a ticket has not been purchased, bookings are automatically cancelled.
3) CANCELLATIONS
Tickets to be cancelled by the passenger's choice may be cancelled up to 24 hours before departure, at the ticket office that issued them, with a penalty of 30% . After this deadline, no refund is due.
4) PRESCRIPTION
- The rights deriving from the contract of carriage of persons, baggage and vehicles are time-barred with the lapse of the terms envisaged by articles 418 and 438 of the navigation code. Article 418 - Prescription 1. The rights deriving from the contract of carriage of persons and unregistered luggage are prescribed with the lapse of six months from the arrival of the passenger at destination or, in case of non-arrival, from the day on which the passenger should have arrived. 2. Rights arising under the contract of carriage of registered luggage shall be extinguished after the expiration of one year from the date of delivery of the luggage or, in case of loss, from the day on which it ought to have been delivered. 3. In the case of carriage which starts outside Europe or the countries bordering the Mediterranean Sea, the period of limitation for the rights mentioned in the preceding paragraphs shall run for one year. In the case of carriage which begins or ends outside Europe or countries bordering on the Mediterranean Sea, the period of limitation is one year.
5) INVOICES
- Tickets do not have invoice value. Passengers interested in obtaining a ticket with invoice value must make an explicit request at the time of ticket purchase, communicating their personal and fiscal data in accordance with Article 22 of Presidential Decree 633 of 26/10/72 and subsequent amendments, and before the ticket is issued.
6) LUGGAGE
- Luggage is considered to be suitcases, travel bags, backpacks and the like, containing personal effects, and travelling with the passenger. Passengers have the right to carry only one piece of baggage with a maximum dimensions of 50x30x15 cm and a maximum weight of 5.00 kg. Baggage in excess of the free baggage allowance will be embarked upon payment of the relevant fee. The baggage ticket only remunerates the maritime passage of the baggage itself. Embarkation, disembarkation, accommodation and safekeeping of baggage during navigation are the responsibility of the passenger. Baggage items may not be placed on chairs or seats, or in such a way as to cause an obstruction to other passengers. Packages not containing personal belongings of the passenger, especially if particularly bulky, will only be embarked if space is available on board, provided that there are no technical or sanitary impediments, and at the unquestionable judgement of the Master. The passenger who introduces substances or objects of illicit possession on board, or that do not comply with current sanitary or legal provisions, shall be liable to the Company for any damages, fines and penalties incurred as a result of such introduction. The Company is not liable for valuables, valuables, money or anything else left in the car or in common areas on board the vessel. In any case, it is up to the claimant to prove the entity of the loss or damage suffered, as well as the fact that such loss or damage occurred during transport.
7) DOGS, CATS AND PETS
- Unless otherwise prescribed by law, dogs, cats and other small live pets are allowed to accompany passengers and against payment of the stipulated fare. No animals may be brought into passenger lounges and rooms, with the exception of guide dogs for the blind. Dogs must be muzzled and leashed. Cats or other pets must be transported in cages or baskets by their owners. The feeding of animals is the responsibility of their owners. The following documentation is required for animals travelling with passengers: a valid health certificate or veterinary certificate stating that the animal is free of disease and, in particular for dogs, that it has been vaccinated against rabies. This documentation may be requested when the relevant ticket is issued or by the on-board staff when boarding.
8) WEAPONS AND DANGEROUS GOODS
- It is strictly forbidden to carry on board firearms, ammunition, explosives, fuel or other harmful or dangerous substances.
9) ON-BOARD PROVISIONS - NOTICES
- From the moment of embarkation on board and until disembarkation, each passenger is obliged to comply with the instructions given by the crew and the notices posted. In particular, passengers shall remain seated during the crossing and during mooring and unmooring operations, and maintain a behaviour that does not jeopardise the safety of navigation. In the event that, at the time of embarkation, or during navigation, a passenger is found to be carrying a weapon, or otherwise appears to be in a condition (due to illness, drunkenness or other reasons) such as to represent a danger or discomfort to himself or others, the Master of the vessel may refuse embarkation and/or take all measures provided for by law.
10) PASSENGER LIABILITY
- The passenger shall be liable for any damage caused by him/her or by a person or animal in his/her custody to the ship, its furnishings, appurtenances and accessories, equipment, other passengers, baggage, the Company's employees or auxiliaries, or third parties, as well as for the payment of any fines, penalties, fines and/or expenses to which the Company may be subject.
11) ACCOMPANYING MOTOR VEHICLES
- The passenger must personally and under his or her own responsibility take care of the embarkation and disembarkation of the vehicle accompanying him or her. Once boarded, the vehicle must be left with engine and lights off, windows closed, not locked, first gear engaged, hand brake engaged and the ignition key inserted in the dashboard. It is at the passengers’ own risk to leave things in the vehicles; the luggage rack may be locked. It is forbidden to board vehicles carrying dangerous or harmful goods, which are not permitted under current regulations, and containers with flammable products in general. It is compulsory to declare at the time of ticket purchase the carriage of vehicles powered by liquid gas. Those who fail to make such a declaration lose their right to board. Vehicles will be called for embarkation in the order that will be arranged by the ship's captain and/or his subordinates and attendants, who will indicate the place where they are to be accommodated. The ship's captain may request the passenger to unload any luggage from the roof of the cars. Any damage suffered by accompanying vehicles during embarkation operations or during the crossing must be reported to the Master immediately or in any case before disembarkation. The Company is not liable for damage to or damage to the vehicle and/or items contained therein. Any damage caused by the vehicle to the vessel and to third parties must be compensated before disembarkation. The embarkation order shall be the sole responsibility of the Master on Board. Fares for accompanied vehicles are inclusive of embarkation and disembarkation fees. The fare groups are as follows: - Group I: up to 4 mt. - Group II: over 4 m. It is also necessary to arrive at the embarkation point with an accompanying car at least half an hour before departure. Passengers who do not present themselves for embarkation within the aforementioned time limit, even if they have a reservation, lose the right to a seat guarantee. In the event of cancellation of the crossing due to weather conditions, the Company declines all responsibility, as it does for all circumstances not directly under its control. Changes: no reimbursement will be granted in the event of a change of date, route or vehicle category. In the event of ticket loss or theft, a new ticket must be purchased. The Company reserves the right to change timetables and fares without prior notice. Vehicle reservation : When purchasing the ticket, it is essential to specify the size and characteristics of the vehicle. Overall measurements are taken into account for the calculation of the fare. In case of omission or false declaration, the company reserves the right to refuse boarding.
12) PROHIBITIONS
- It is forbidden for passengers to include in their luggage or embark vehicles carrying inflammable or otherwise dangerous materials, contraband, to carry letters and parcels subject to postal taxes, goods subject to State property rights, or which are otherwise forbidden to be exported. It is also forbidden to bring objects into the boat's saloons that may cause annoyance or disturbance to passengers, to lie on the sofas, to open or close the windows without contacting the crew. Failure to comply with the aforementioned prohibitions is the passenger's responsibility towards the competent authorities and towards the Company, which reserves the right to claim compensation for any damages, fines and penalties to which it may be subject. Passengers are obliged to pay compensation for any damage caused to the boat and onboard furnishings.
13) BOARDING
- When boarding, passengers are obliged to show their ticket and documents proving that they are entitled to a fare reduction or waiver to the on-board staff.
14) ITINERARIES AND TIMETABLES
- The ship's departure and arrival times and itinerary are subject to change, even without prior notice, for technical reasons or force majeure. for these reasons, the Company reserves the right to cancel or modify the scheduled trips in whole or in part and also reserves the right to cancel departures or stopovers for the same reasons. Should the itinerary of the trip have to be changed for technical reasons or force majeure, the passenger must disembark at the port of new destination and no refund or compensation will be due. Passengers are therefore required to ask for confirmation of itineraries and timetables, well in advance, at the ticket offices of the port of call, making sure - before departure - that there are no changes to the ship and timetable shown on the ticket. In this case, the passenger may ask the ticket office to be allowed to depart, if there is availability of seats, with another journey made by the company, or he/she may renounce the journey itself, against reimbursement of the ticket price, which will be made at the issuing ticket office. No further compensation or damages will be paid by the Company, whatever the cause of cancellation or modification of the journey.
15) LIABILITY’
- Passengers, cars and luggage will be transported at the passenger's own risk. The Company declines all responsibility for damage to persons or property, or theft of cars or luggage. No responsibility can be attributed to the Company for greater expenses caused by delays or omissions of trips due to technical or mechanical failures of its vehicles, or in any case due to causes beyond its control such as illness, bad weather, strikes, quarantines, wars, force majeure. Schedules, fares and travel conditions may be changed without notice.
16) COMPLAINTS - ACCIDENTS - CLAIMS
- Any claims must be notified in writing directly to the Company. Accidents or damage to persons or property must be reported immediately to the Master of the ship on which the voyage was made.
17) POSTING AND VARIATION OF REGULATIONS AND TARIFFS
- These regulations are posted for the public's appropriate knowledge on the premises of each of the Company's agencies and in the on-board passenger areas.
18) INTEGRATION AND AMENDMENTS OF THE REGULATION
- The Company reserves the right to supplement or amend the conditions governing the user relationship at any time. The relevant communications will be validly made by the Company by means of a notice displayed at the Company's Offices and Ticket Offices and at the Commands on board, and will come into force as of the date indicated in said notice.
19) JURISDICTION.
For any controversy that may arise regarding the interpretation and execution of the present Contract of Carriage, the passenger accepts Italian jurisdiction and the competence of the Court of Naples, without prejudice to the Company's right to bring any other competent Court, Italian or foreign. Recorded in Naples on 27/09/2004 at no. 101346/3, at the Agenzia delle Entrate - Ufficio Napoli 1°.

General Terms and Conditions of Alilauro

Below are the general conditions of carriage of the ALILAURO company.

These conditions indicate the rules to be applied for the carriage of passengers and their effects on the units belonging to the Lauro Group. These regulations are understood to be accepted in full, by the passenger, at the time of purchasing the ticket, which makes express reference to them. The purpose of the contract is transport as governed by articles 396 et seq. of the Navigation Code and European Regulation 1177/2010 . The indication of the vessel that will perform the carriage is merely indicative, as substitution with another vessel is possible. The carrier is not liable for damage caused by delay or non-execution or inexact execution of the carriage if the event is the result of unforeseeable circumstances, force majeure, adverse weather and sea conditions, strikes and technical failures constituting force majeure or other causes not attributable to it. In the event of events that may compromise the safety of the ship and/or passengers, the ship's Master has the right to change the itinerary. The advertised fares and conditions may be subject to change until the ticket is issued. For anything not provided for in these conditions regarding the liability regime in relation to the carriage of passengers, express reference is made to the current regulations of the Code of Navigation. Until disembarkation, passengers are responsible for their luggage and its contents. Crossing times are indicative and calculated on the basis of the distance between ports, in favourable weather conditions. The Company cannot be held responsible for delays due to port operations.

1. TICKETS  A prerequisite for travelling on Alilauro's vessels is that the passenger is in possession of a regular ticket, which can be purchased at all authorised points of sale and also via the Internet. The ticket constitutes a contract of carriage and must be kept for the duration of the journey. If the ticket indicates the passenger's name as compulsory for particular routes or even if there is no such indication, it may not be transferred without the express consent of the carrier. The Resident Ticket is strictly personal and valid only if presented to the crew upon boarding together with a valid identification document. The application submitted by the user to the competent Registry Office and aimed at obtaining a change of residence is not a suitable document to prove the existence of an established residence and, therefore, does not confer any right to the facilitation envisaged for residents. Holders of a concessionary ticket may have their ticket and identification document jointly checked by authorised personnel throughout the journey. The presentation of the ticket entitles the passenger to embarkation and transport to the destination of arrival; if, however, in the unquestionable judgement of the Captain, the Navigation Company or the competent Authorities, there are security reasons that prevent embarkation, the passenger will be denied. The ticket is only valid for the one journey indicated on it. Tickets not used by the date of departure will lose their validity without the right to reimbursement. 

2. LOST OR STOLEN TICKETS In the event of theft, loss or misplacement of the ticket, the passenger is obliged to report it to the Police and promptly inform the Company. The passenger shall deliver to the Company's Office or Agency a copy of the report submitted to the competent authority and pay the price of a new ticket. If the lost/stolen ticket is not used within six months of the departure date indicated on it, the Company shall refund the price originally paid by the passenger.
 
3. PASSENGERS WITHOUT OR NOT ENTITLED TO A TICKET Passengers who are not able to show their ticket, holders of concessionary fare tickets who do not have the right to do so will be subject to payment of the administrative sanctions provided for by Regional Law no. 13 of 13/08/1998 (the administrative sanction is equal to 100 times the amount of the ticket due and in any case not less than € 77.47). In the event of improper use of the ticket, the above penalty will be applied. Anyone embarking without a ticket for any reason whatsoever must promptly notify the on-board staff so that the latter may issue a ticket plus €10.00. The Master of the vessel will in any case be informed. Failure to immediately report the lack of a ticket at the time of embarkation shall result in the administrative sanction due for the lack thereof. The Company reserves the right to take all the measures provided for by the Laws and Government Acts in force against any passenger who uses its services on more favourable conditions and without being able to prove entitlement.
 
4. TARIFFS The fares applied by the Shipping Companies belonging to the Lauro Group can be found on the company websites and are available at the Company's ticket offices and at the on-board controls. Children under 4 years of age are granted free passage, with the issue of an “infant ticket”, but are not entitled to a seat; if they occupy a seat, payment of the ticket is due. A child fare is payable for children aged between 4 and 12 years. On reaching the age of 12, users are required to pay the full fare. The age of children must always be documented and proven at the time of boarding. Passengers who are unable to show their ticket, holders of concessionary fare tickets who are not entitled to do so will be subject to the payment of the administrative penalties set out in art. 4 of these General Conditions of Carriage. Minors under the age of 18 cannot travel on Alilauro vessels unless accompanied by a person of legal age (eighteen). Residents on the islands served by the connections are granted concessionary fares as provided by the Regional Authorities - the issuance of the ticket thus conceived can only take place upon presentation of the Identity Card or Resident Card - the only documents considered valid by Alilauro for the purpose of proof of residence. The ticket and the relevant document must be shown to the staff whenever requested at the time of purchase, check-in, boarding, during the journey and/or upon disembarkation. Possession of the ticket in any way acquired does not exempt the passenger from complying with the rules indicated in these Regulations nor from complying with the Laws and Government Acts as applicable during carriage on board the Company's vessels. The Company may accept the purchase of tickets also in the days preceding the day of departure - through its sales outlets and via the Internet - by applying the surcharge envisaged in the tariff that includes the booking fee.
 
5. TYPES OF TARIFFS The journeys indicated as Regional Alilauro is obliged to carry them out at fares predetermined by the competent authorities for the remaining ones the company is not obliged to apply any predetermined fares, but may apply the fares that are most convenient for it in commercial terms. For residents of the islands, concessionary fares are recognised, established independently by the company itself, with the sole obligation on the part of the company to communicate the fare plan. 2. Only full fares shall be applied to Extraordinary Journeys, with no concessions for island residents and workers.
6. PRESENTATION AT EMBARKATION Passengers are required to arrive at the boarding gate at least 15 minutes before the scheduled departure time, failure to comply with the established times determines the Company's right to prevent the user from boarding if the security conditions guaranteed by these times are no longer met, duly provided with the ticket; for bookings purchased online and/or from the Call Centre, passengers must present themselves at the boarding gate with the printed ticket. They must also comply with the methods and procedures provided for transit on the quayside and for boarding, slavishly observing the signs posted for this purpose and maintaining a civilised and respectful behaviour towards other passengers, on-board staff and pier personnel, as well as safety and public hygiene regulations, avoiding climbing over barriers and throwing objects on the ground or into the sea or outside the bins provided for waste collection. It is imperative that boarding orders are respected without climbing over the queues on the approach routes to the accesses on board and that the instructions given by the personnel operating at the quayside are respected. Any non-compliance will lead, if necessary, in addition to the possible reprimand by the personnel in charge of controls in the boarding areas, to the intervention of the Police Force immediately summoned for action.
 
7. PASSENGER BEHAVIOUR ON BOARD Passengers are required to behave in a civil and respectful manner, avoiding any offensive or detrimental behaviour towards other travellers and navigation personnel as well as towards safety and public hygiene regulations. In particular, he/she must not defile seats and furnishings or throw objects on land or in the sea or outside the containers provided for waste collection, must use toilets without causing them to become clogged or soiled, and must comply with the instructions given on board during navigation. Furthermore, he/she shall not occupy more than one seat per person, bearing in mind that the purchase of a ticket does not constitute an automatic right to the availability of a seat and that the capacity of the vessel, in terms of the maximum number of people that can be carried, is determined according to the specific regulations in force. Any non-compliance will lead, if necessary, in addition to the possible reprimand by the staff in charge of on-board controls, to the intervention of the Police Force, which may be summoned for action within its competence.
 
8. LUGGAGE Each passenger may take on board a single item of baggage with maximum dimensions of 50 x 35 x 20 (cm) and weight not exceeding 9 kg. Special fares will be applied for additional baggage and for baggage exceeding the above-mentioned dimensions and/or weight, the amount of which will be determined according to the size and weight of the excess baggage. It is the user's obligation to check and take note of the weight and size limit of the baggage and obtain the relevant ticket. This baggage will be duly registered with a special tag applied to the baggage itself with corresponding evidence to be given to the passenger at the time of ticketing. In the case of baggage without the appropriate ticket valid for embarkation and the corresponding tag, an administrative penalty will be applied as indicated in point 4. The Shipping Company or the Master of the vessel may at their discretion refuse to embark baggage whose bulk or weight constitutes an impediment to good navigation.Any claim involving damage to or loss of baggage items attributable to the carrier will be handled in accordance with the provisions of articles 412, 413 and 414 of the Code of Navigation, Chapter III, Section I. (reimbursement up to a maximum limit of 6.2 euros per kilogram of baggage). Claims regarding loss of or damage to baggage must be made at the time of disembarkation and must be accompanied by proof of its declaration made at the time of embarkation, as received at the point of sale. Claims regarding loss of or damage to baggage will not be accepted unless accompanied by proof and made prior to disembarkation in discussion with the Company's personnel; the description of the damage will be noted on a special form signed by the passenger and the ship's captain. If necessary, the on-board staff may assist the passenger in boarding and disembarking baggage, it being understood that the porter service remains the responsibility of the latter. Any baggage left on board or in the boarding area without custody and not claimed by any passenger entitled to collect it will be kept in a place deemed suitable by the Shipping Company for a maximum period of 30 days (at the Naples Terminal), after which time any unclaimed items found will be handed over to the Mayor of the Municipality where they were found, but in any case the same will be done at the time of discovery, if provided for by the procedures relating to the prevention of unlawful acts or also if deemed appropriate by the Captain of the unit or by the staff in charge of supervising the boarding areas, to inform the Police so that they can take the necessary measures. 
 
9. PETS Pets are permitted on the Company's vessels under the following conditions - only one animal per passenger is permitted; - the animal must be definable as “domestic” in the common meaning of the term; domestic animals are defined as animals such as dogs, cats, cage birds and the like; - the animal must be of small or medium size; particularly large animals may be denied boarding or accepted on condition that carriage is carried out under special conditions that do not cause annoyance or damage to passengers; - dogs must be leashed and muzzled; - the presence of the animal must be reported in advance when purchasing the ticket; - the surcharge indicated in the table in the appendix to these Regulations will be applied to the ticket; - health certificates attesting to the animal's state of good health and vaccination may be required as a condition for boarding; in this case, the date of issue of such certificates must not be more than three months prior to the date of ticketing. In the case of animals without a valid ticket for boarding, an administrative penalty will be applied as indicated in point 4.
 
10. DELAY OF DEPARTURE - TRIP INTERRUPTIONLATE ARRIVAL TIME The cancellation, delayed departure and interruption of the voyage are governed by Articles 403, 404 and 405 of the Shipping Code respectively. Arrival times, where foreseen, are to be understood as indicative and may be subject to change as a result of weather and sea conditions, port traffic, limitations imposed by the competent authorities or other entities not attributable to the Company. In the event that the responsibility of the carrier for the delay in arrival is proven, the difference between the cost of the hydrofoil ticket and the cost of the ferry ticket will be reimbursed.
 
11. OBSTRUCTION OF THE SHIPSUPPRESSION OF DEPARTURECHANGE OF ITINERARY In the event that the departure is cancelled on the initiative of the Shipowning Company but for reasons not attributable to the latter, the passenger must be refunded the ticket price as already paid. If, on the other hand, the cancellation of the departure is caused by justified reasons attributable to the Owner and the trip cannot be made with other units made available to the passenger by the Company itself or if the passenger does not accept to make the trip with later departures than the scheduled one, the refund of the ticket price will be due. In this case, any compensation for damages attributable to the cancellation of the departure - to an extent not exceeding twice the net price per passage - may only take place if such damages can be clearly proven. Any change of itinerary or timetable caused by causes attributable to the carrier and for which the passenger refuses passage will be treated in the same manner.
 
12. REFUNDS The contract, once concluded, cannot be terminated by the contracting parties. The Company, however, by way of derogation from Article 400 of the Code of Navigation, grants the passenger who does not intend to or can no longer depart the right to obtain reimbursement of part of the passage price under the following penalty conditions: I. For tickets cancelled up to 10 days before departure the refund will be 90%; II. For tickets cancelled up to 2 days before departure the refund will be 50%; III. For tickets cancelled within 48 hours prior to departure there is no refund. IV. Tickets issued with special fares are non-refundable and non-changeable. Notification of the cancellation by the passenger must be notified, in writing, to the booking centre for tickets purchased online by sending an email to the following address reservation@alilauro.it. Refunds will be made by bank transfer within 30 days from the date of the request net of bank charges and pre-sale fees.
 
13. CHANGE OF TICKET Changes to the date and time of the ticket are permitted subject to the company's verification of seat availability, provided that they are requested within 1 hour of the time of the booked departure and limited to the service hours of the telephone booking office and/or stopover ticket offices. The change of the ticket shall entail the payment of the change fee. The passenger is also required to pay any surcharges, where applicable. The change is only permitted within the scope of departures published in the timetable and is not permitted for extraordinary journeys. The original ticket, which predates the change, must be handed in when the new ticket is issued.
 
14. MISSED DEPARTURE ATTRIBUTABLE TO THE PASSENGER In the event of a missed departure due to the unavailability or delay of the passenger, no refund of the ticket is due to the latter if already purchased. For delays or missed departures that the Company's units may suffer due to the passenger, the sanctioning measures against the latter will be applied in the manner and under the terms provided by the State Laws and Regulations in force.
 
15. SPECIAL TARIFFS All special and/or promotional fares are available while seats last and are automatically proposed by the various booking systems. Unless otherwise stated, special fares cannot be combined with other promotional fares. These fares are non-changeable and non-refundable.
 
16. PORT TAXES AND BOOKING FEES The fares in force are net of surcharges due to possible increases in fuel costs, taxes and port fees, the amounts of which are subject to change until the ticket is issued. In the event of booking, through Call Centres, stopover ticket offices and the Internet, a booking fee per passenger per route is applied to the ticket price. This fee is indicated before the final purchase of the ticket. For each passenger, where applicable, surcharges, taxes and port fees are also applied. Booking fees are non-refundable.
17. TRANSPORT OF DANGEROUS OBJECTS The carriage of dangerous objects is not permitted on units belonging to the Company. Special conditions may be required for certain types of objects to be accepted on board. In particular, the carriage of weapons of any kind is forbidden, with the exception of those in the personal possession of the Armed Forces and Police Forces, the carriage of blunt objects, substances included in the official lists of dangerous goods, combustible liquids, narcotic substances, and other substances whose carriage or possession is considered illegal according to the laws of the State and regulations in force. In any case of doubt, the captain must be informed of the contents of the baggage to be carried.  

General Terms and Conditions Aegean Sea Lines

Below are the general conditions of carriage of the company in question in English.

PASSENGER’S TICKET TERMS :

1. The boarding ticket is personal, nominal and non transferable and it is valid only for the class and the particular trip it has been issued for.

2. According to EU Directive 98/41 it is mandatory, for safety reasons, to list by name all passengers on every sailing.

To make that possible, tickets are issued BY NAME and specifically must include:

– PASSENGER’S FIRST AND LAST NAME – GENDER: MALE/FEMALE – AGE: ADULT-CHILD-INFANT

Passengers are advised to provide their travel agency with a telephone number (preferably a mobile phone number) so they can be contacted in case of emergency e.g. cancellation of departure due to bad weather conditions etc.

3. Passengers should board on the vessel an hour prior to departure. If passengers miss departure, the ticket value will not be refunded. In case a passenger wishes to cancel his/her ticket prior to the vessel’s departure, he/she is entitled to receive half of the ticket fare.

4. Children up to 4 years old: it is obligatory to issue a Free of Charge ticket. , whereas children from four (4) years up to ten (10) years of age pay half the price of the ticket.

5. In case of loss of a ticket, that will not be replaced or refunded. In case of loss of tickets it is necessary to buy new tickets. Subsequently, a claim should be lodged with the company as soon as possible and in any case prior to the voyage date, stating the date, itinerary and serial number of the lost tickets, as well as photocopies of the new tickets.

6. The ship-owning company has no responsibility for any luggage damage or loss.

7. The ship-owning company is by no means responsible for any delay of the vessel’s schedule, deviation and inconsistency to the standard route due to bad weather conditions or special orders by the Ministry of Defence or by the Port Authorities for act of God reasons.

8. Passengers are responsible to keep the Port, Sanitary and Customs rules.

9. Passengers should discipline to the instructions given by the captain or the crew for matters concerning the conservation of order and safety of the vessel.

10. There is a complaint box available on board the vessel. Any passenger who wishes to make a complaint wiil be assisted by the crew.

11. If the trip is cancelled at the company’s fault, the ticket fare will be refunded to the passengers. The ship-owning will have no other obligation.

12. The ship-owning company retains the right, following the Ministry’s approval, to replace the vessel, for which a particular ticket has been issued.

VEHICLE TRANSFER PROOF CONDITIONS

1. The driver is obliged to load and unload the vehicle.

2. The vehicles should be in the loading area an hour prior to the vessel’s departure.

3. The driver will not be entitled to receive a refund of the ticket fare if he/she misses the vessel’s departure. If the driver declares before the vessel’s departure he/she is not willing to travel, then he/she will be entitled to receive a refund of the corresponding amount of the ticket, according to commercial policy.

4. In case of loss of the vehicle tickets, these will not be refunded.

5. Passengers others than the driver of the vehicle are obliged to step out of the vehicle prior to loading.

6. Passengers should carry with them any items they may need during the trip. After the vessel’s departure any access to the parking area is forbidden.

7. Embarkation priority is defined by the Port rules, the relevant Authority and the shipowning company.

General Standards

1) The purchase of a ticket implies the Passenger's acceptance to all effects of law of the following general conditions of carriage.

2) Definitions. The term Passenger shall mean any person carried on the basis of the ticket. The term Carrier means the Company that performs the maritime carriage. All employees, agents and auxiliaries of the Carrier may benefit from the rights guaranteed to the Carrier by the present general conditions.

3) Jurisdiction. All disputes that may arise between the Passenger and the Carrier in connection with this contract will be referred to the competent Ordinary Judicial Authority.

4) Loading unit. For all legal purposes, the vehicle transported -including any trailer or caravan, with its contents- constitutes a single load unit loaded without declaration of value.

5) Fares. These are those in force at the time the ticket is purchased and indicated on the ticket.

6) Personal and Vehicle Damage. The carrier's liability, if any, for damage to persons and vehicles transported is insured in accordance with the provisions of the applicable flag law and international conventions.

7) Booking: Online booking is done with just a few clicks and in complete security. Fare and availability information is provided in real time by the company issuing the ticket. The prices that appear during the quote request are guaranteed for the duration of the user's connection to www.corsicaferries.com and/or www.sardiniaferries.com. Your reservation only becomes final when you click on the “Confirm” button and when you receive confirmation of your credit card transaction. Your reservation may be cancelled, without penalty, by midnight of the day on which it was made; after this deadline, the cancellation will be subject to the usage fees. Changes in date, time, line and services made on the day of the reservation will not be subject to penalties, however any differences in fares will be charged. You will see a 7-digit confirmation number and a summary of your booking on the screen. Your ticket will be sent to you by e-mail, free of charge, to the e-mail address you provided.

8) Type of Payment - Credit Card

The following credit cards are accepted:

Transactions are carried out in total security, thanks to the SSL (Secure Socket Layer) encrypted system.

All transactions are made in Euro, including Switzerland.

Payment transactions take place at the time of ticket purchase, after clicking on the “Confirm” button.


Tariff application

9) Application of ferry fares: Prices vary depending on the time of booking and the fare applied to the chosen journey. Passenger fares may vary depending on whether they are booked with or without a motor vehicle (car, motorbike, camper van, etc.). The discount for children concerns the price of the crossing and not the price of cabins and the supplement.
Discounts and/or special rates cannot be combined.
For bookings made via the Internet, a transaction fee of €6 will be charged as a refund, which is non-refundable even if the contract is cancelled. The Company reserves the right to apply any fare surcharges after the purchase of the ticket, depending on increases in fuel prices or fiscal burdens in application of safety regulations and the ISPS code. Should the passenger not wish to pay the aforementioned supplements, he/she may cancel the reservation and obtain a refund of the ticket.

Promotional rate tickets: Tickets containing a promotional rate service are neither changeable nor refundable in the event of partial or total cancellation.

Standard Fare Tickets: Standard Fare tickets may be changed but a fee of € 30.00, per crossing, must be paid and any fare differences will be collected. These tickets are not refundable either in part or in full.

FLEX fare tickets: FLEX fare tickets can be changed and any fare differences will be cashed in for each change. The FLEX fare option can only be purchased at the time of booking. In the event of total or partial cancellation, FLEX fare tickets will be subject to the following penalties, on the total ticket price - excluding taxes:

  • 10% up to one month before departure
  • 20% up to 48 hours before departure
  • 50% up to boarding presentation time limit
  • 100% beyond the boarding time limit

Tickets cancelled after the boarding time limit (1 hour before departure) or after check-in will not be refunded and will lose their validity. For ticket cancellations where a change of date has been made, the original day of departure will be taken into account.

Failure to show up for embarkation will also invalidate the ticket, which cannot, under any circumstances, be refunded. In the event of total cancellation of the ticket paid for by credit card, and with reimbursement of taxes (port, regional and security taxes), a handling fee of € 1.50 will be charged.


Changes: FLEX Tariff and Standard Tariff

No refund will be given in the event of a change in date, time, route, type of accommodation or vehicle category. On the Standard fare, a sum of €30 will be levied for any change to the ticket (including the car number plate) and any fare differences will be cashed. On the FLEX fare, a sum of €30 will be levied for any change to the ticket and any fare difference will be cashed. No refund will be given if the fare of the new journey is lower than that of the originally booked journey. Changing the name of one or more passengers is not permitted. In the event of a change of accommodation on board, no refund will be given for changes requested by the passenger (e.g. change from booked cabin to seat) a fee will be charged for any changes to the ticket.

Vehicle reservation: When making the reservation, it is essential to specify the dimensions and characteristics of the vehicle. The overall dimensions (length, height and width) are taken into account for the calculation of the fare and must be declared at the time of booking and when purchasing the ticket. Vehicles exceeding normal dimensions: vehicles exceeding 5.00 m in length and/or 1.90 m in height and/or 2 m in width, subject to payment of a surcharge, must be declared at the time of booking. In the event of omission or false declaration, the Company reserves the right to refuse boarding or to collect the amount due, even on the outward journey even if already made.


Ticket

10) Validity. The ticket is valid only for the persons to whom it is issued, for the ship for which it is issued and for the accommodation and departure indicated on it. The ticket cannot be transferred. Unless otherwise expressly stated, the ticket price is per person and place, excluding food, and includes VAT, if due.

11) Safekeeping. The Passenger is not required to keep the paper copy of the ticket. Our boarding system is computerised, which has enabled us to simplify and limit the documents required for travel. Tickets can take a variety of forms:

    • - Paper ticket, received by post
    • - Tick@mail, received by email
    • - Tickefax, received by fax
    • - Copy screen (print screen)
    • - Agency Voucher
    • - Sms ticket

All these forms are valid, but it is essential that the 7-digit booking number, allocated by our central reservations office, appears on it. This number may also be communicated verbally at the time of embarkation or in the event of checks carried out by the Company's staff, during the journey and/or at the ports of departure and arrival.


Boarding Rules

12) Presentation. The Passenger, with or without vehicle, must present himself/herself directly to the ship within the time limit indicated in the current publications (tickets, timetables, fares and other notices): : with vehicle 1 hour before departure, without vehicle 1/2 hour before departure. After this time, the Passenger loses all boarding rights. Departures may be brought forward by 1/2 hour with respect to the published timetable.

13) In compliance with the international ISPS code, relating to anti-terrorist regulations, passengers will be obliged to show the hard copy of their ticket (if received) and a valid identity document and must consent to the inspection of their vehicle and baggage, if requested by a ship's officer or Company personnel, before boarding and during the crossing. Any refusal will result in denial of embarkation. Passengers are therefore kindly requested to carry with them at all times: a valid identity document, proof of any reduction and a paper copy of their ticket (if received) or they can communicate their booking number.

14) Vehicles. Regardless of the order of presentation, the Carrier and/or the Commander and/or the Loading Agents have the right to establish the order of embarkation of vehicles at their sole discretion. If, due to force majeure, the Carrier is unable to embark a duly booked vehicle, such vehicle will take precedence on the next departure without the passenger being able to claim compensation of any kind. If, on arrival at the port of destination, sea conditions or other causes beyond the Carrier's control do not allow the vehicles to be disembarked, they will be disembarked, as soon as possible, at the next landing or at the port of origin without the Passenger being able to claim any compensation. For any vehicle whose measurements do not correspond to those declared at the time of booking, the Carrier reserves the right to refuse boarding and/or to charge the freight for oversized vehicles. Embarkation and disembarkation operations must be carried out personally by the Passenger-driver. The vehicles must be driven up to the entrance of the ship's door in the case of embarkation, and from the entrance of the ship's door onwards in the case of disembarkation, under the direct and exclusive responsibility of the Passenger-driver, who must comply with all the safety regulations in force for circulation on the port quays concerned. Inside the vessel, the Passenger-driver must position the vehicles according to the instructions given by the crew. Embarked vehicles must be left closed and secured by the Passenger Driver with the first gear engaged and the parking brake applied. The transport of perishable goods is not recommended due to the high temperature of the garage.

15) Luggage. Each foot passenger is entitled to free carriage of hand luggage. Baggage must contain the passenger's personal items that are carried in suitcases, boxes or similar, that do not have bulky structures and whose dimensions do not exceed 200 cm. in height, 100 cm. in width and 50 cm. in depth. Passengers may take their own luggage with them in the cabin or in their assigned seat, at their sole responsibility. Canoes, kayaks and other oversized luggage, if not carried on the roof of the vehicle, shall be stored in the ship's garage upon acceptance by the loading officer. Such luggage will be subject to the payment of fees stipulated by the Company. The Company declines all liability in the event of theft or damage to luggage. Valuables and money shall be considered as handed over to the carrier only if deposited against payment of a fee with the Purser.
The Carrier assumes no liability either for luggage stored by the passenger or for luggage placed in the areas set aside for this purpose, unless proof of the Company's fault is provided. However, even if the Company's liability is proven, the lump-sum compensation shall not exceed the sum of €300.00.

16) Passenger health conditions - Pregnant women
Passenger's medical condition : Special medical conditions must be declared at the time of booking. The carrier may deny boarding to passengers who require medical assistance during the journey as the on-board doctor, where present, provides assistance only in cases of emergency. If the passenger presents a suitable medical certificate issued by a public health facility (hospital, ASL) stating that he/she does not require medical assistance during carriage, the carrier will board him/her, declining all liability in this respect. The Master also has the full right to refuse embarkation to anyone who is in a physical or mental condition that does not allow them to undertake the journey or to anyone who, due to the abuse of drugs, hallucinogens, alcohol, is dangerous to other Passengers. In all of the aforementioned cases, the passenger shall not be entitled to compensation for damages and shall be liable for damages caused to his or her person, the ship, all of its fittings and/or equipment, third parties, as well as third parties' property. The acceptance of the passenger on board by the carrier shall not be considered as a waiver of any right to assert later reservations on the passenger's condition, whether or not known to the carrier at the time of embarkation and/or departure of the vessel.
Pregnant women : Pregnant women who have completed their 6th month of pregnancy must be in possession of a medical certificate authorising travel, which must be presented at the request of the cabin crew. In the case of pregnancy with complications, the pregnant passenger must be in possession of a medical certificate authorising travel, regardless of the month of gestation. The captain also has full authority to refuse boarding. The carrier's consent to embarkation shall not be considered as a waiver of its reservations regarding the passenger's condition, whether or not known to the carrier at the time of embarkation and/or departure. The passenger shall not be entitled to compensation for damages and shall be liable for any damage caused to her/himself, to the vessel, to all its fittings and/or equipment, to third parties and to third parties' property.

17) Handicapped persons or persons with reduced mobility must indicate their condition when making reservations and report it on arrival at the port at least 1 hour before departure, so that the crew can do everything possible to make the journey more comfortable for the handicapped passenger.

18) Animals. Pets are accepted on board and may circulate on the ship's premises except in the restaurant. Dogs whose breed is considered dangerous under current legislation are not accepted. In some cases, the ship's staff may impose certain restrictions on their movement. The company may require a certificate of vaccination and good health valid for no more than three months from the date of issue. Dogs must be kept on a leash and muzzled. It is forbidden to leave animals in the car. During the crossing, the garage is not accessible and the temperature, especially in summer, can be very high. The company declines all liability for damage, of any kind, that may occur during the crossing (illness, injury or death of the animal).


Special responsibilities and obligations of the passenger

19) Liability of the Passenger. The Passenger is liable for any damage caused by him/her or by persons or animals in his/her custody to the ship, its furnishings, appurtenances and accessories, its equipment, other passengers, the Carrier's employees or its auxiliaries, third parties, as well as any sanctions, fines and/or expenses to which the Carrier may be subjected by any authority of any country due to his/her actions.

20) Weapons. It is prohibited for the Passenger to carry on board firearms, ammunition, explosives, fuel or other dangerous or inflammable substances without the Carrier's written consent and the necessary legal authorisations, to be obtained by the Passenger. In this case, these items must be handed over to the Purser and will only be collected upon disembarkation.

21) Illegally held baggage. Passengers who include in their baggage or otherwise introduce on board illegally held or smuggled substances and objects will be liable to the Carrier and/or other obligated parties for any damages, fines and penalties that they may incur as a consequence of such introduction.

22) Vehicles powered by liquid gas. At the time of reservation, ticket purchase and boarding, the Passenger must declare whether or not the accompanying vehicle is fuelled by liquid gas.


Liability and rights of the carrier

The carrier's liability and rights are governed with regard to the carriage of persons and baggage by Chapter III Section 1 of the Code of Navigation, and with regard to motor vehicles, by Articles 422 and 423 of the Code of Navigation and/or by the International Maritime Transport Conventions where applicable.
As far as the Corsica Express II and Corsica Express III fast ferries are concerned, for technical reasons relating to passenger comfort and navigational safety, it will not be possible to make crossings in the presence of waves higher than 3 metres.
If the Master, at his sole discretion, finds such weather and sea conditions, the ship's departure will be cancelled due to force majeure and the passenger will retain the right to make the crossing on a subsequent departure of another traditional ship of the carrier.
In such cases, the passenger shall only be entitled to be reimbursed for any difference in fares, to the exclusion of further damages.
Liability of the actual carrier: if the carrier operating the carriage is not the contracting carrier, the actual carrier assumes liability for the carriage in accordance with Article 1681 of the Civil Code, so the passenger has the right to act directly against it. The indication of the actual carrier, if different from the contracting carrier, may be made at the time of booking in which case it is indicated on the ticket or by communication within 24 hours of departure.

The following are the general conditions of carriage of the company in question.


In compliance with SOLAS regulations and Community Directive 98/41, implemented by the Hellenic State by Presidential Decree 23/99, it is mandatory, for safety reasons, to provide the following information at the time of booking: Surname and First Name (initials), gender, age (specifying whether adult/child/infant), nationality and any information relating to a request for special assistance in emergency situations, type of vehicle and registration number. Passengers with non-European citizenship must also provide their passport number and date of birth.

Bookings/Tickets
They can be made at Central Offices, all authorised Travel Agencies, the Reservation Centre, or at Port Offices. The ticket is valid for one year from the date of issue and can only be used for the port of departure for which it was issued. The ticket is nominative, non-transferable to third parties, and is valid only for the route and accommodation for which it was issued. Any changes must be communicated to the issuing agency or to the Company's Central Offices or Port Offices. Open date tickets: these are valid for one year from the date of issue and it is advisable to book your trip well in advance, especially during the high season. Any differences in fares must be settled by the passenger and the validation of the ticket will be the responsibility of the issuing Agency or Central Offices or Port Offices.
Cancellations
From the date of issue and up to 30 days before departure: 100% refund From 29 days to 7 days before departure: 75% refund From 6 days to the day before departure: 50% refund On the day of departure: no refund is due for cancellations and/or no-show at departure. Refunds are only made by the Issuing Agency.
Lost Tickets
If tickets are lost, passengers must notify the Issuing Agency or the Company Head Office in writing. Duplicates of lost tickets cannot be issued without payment of the corresponding price. Any refund will be made 3 months after the date of travel only if the lost ticket is found to be unused.
Limitations of Liability
In the event of cancellation of a voyage, the Company shall have no obligation other than to refund the tickets in full. The Company reserves the right to substitute the ship for which a ticket has been issued, after approval by the Ministry of Merchant Marine Schedules, fares, conditions may be changed without prior notice. The published arrival times indicate the arrival of the ship at the port (pilot station). The Company assumes no responsibility for delays or cancellations, for deviations or changes of route, due to bad weather conditions or orders imposed by the Ministry of the Merchant Navy, Port Authorities, or force majeure.
Tariffs/Reductions
The published rates refer to sea passage only for the chosen accommodation (including port fees). Meals and drinks excluded. The 30% reduction is valid only for international routes, returning from any port, and is only applicable if both outward and return journeys are booked at the same time. Promotions are not cumulative or retroactive. Passengers entitled to any discounts must give notice of this at the time of booking as no refund can be made for the difference afterwards. There are special fares for groups, trucks, buses and unaccompanied vehicles.
Cabins
Cabins are defined as double, triple or quadruple by the number of occupants and not by the number of beds inside them.
Children
Up to 4 years of age free of charge, without the right to a bed or seat, and the obligation to issue a ticket. From 4 to 12 years of age 50% reduction.
Boarding Instructions
Motorised passengers must present themselves at the boarding offices no later than 2 hours before departure (1 hour for non-motorised passengers). Otherwise, the Company will be free to dispose of their seats without any obligation for reimbursement. Vehicles embark according to the current provisions of the local Port Authorities. Embarkation/disembarkation operations are carried out by the drivers of the vehicles themselves according to the instructions given by the on-board staff. It is forbidden to embark the vehicle with passengers on board. The vehicle category is indicated on the ticket as declared by the passenger.
Safety on board
Neither the Company nor the ship are liable for any accident, loss or damage occurring before embarkation, during loading and after disembarkation. It is strictly forbidden to carry weapons, explosives, flammable liquids or any dangerous goods.
Passengers with special needs
- On the ships there are cabins and common areas specially designed for easy access and use by passengers with special needs. Due to limited availability, booking well in advance is recommended. Luggage - May be left inside the vehicles. Passengers are kindly requested to take only what is necessary during the journey as access to the garage is not permitted during navigation. - The Company accepts no liability for the loss of money, valuables left in vehicles, luggage, cabins or common areas. Passengers may leave sums and valuables in the custody of the Purser. Common areas - All passengers may use the ship's common areas free of charge. It is however forbidden to sleep or consume meals inside the lounges and bars. Camping on board - This takes place from 1st April to 31st October. - Passengers using this formula still have free access to all common areas of the ship. The supply of electricity, water, toilets and showers is free of charge. Camping on board is a service governed by the regulations of the local Port Authorities. - For safety reasons, the use of open flames during the entire stay on board is strictly forbidden.
Credit Cards
AMERICAN ESPRESS, DINERS, VISA, MASTERCARD, EUROCARD are accepted for purchases at shops and in the on-board restaurant. The official currency on board is the Euro.
Pets
Transport is free of charge. Pets will be accommodated on board in special kennels on deck. Pets are not allowed in the cabins and common areas inside the ship. Feeding and cleaning are the responsibility of the respective owners. A valid health booklet is required.
General Instructions
Passengers are required to observe the regulations of Port, Health and Customs Authorities. Passengers must comply with the instructions of the Captain of the vessel and his crew regarding public order and safety on board. travel. The contract of carriage is subject to Greek Law. Passengers must contact the Captain of the ship, or the deputy, with any complaints. The following are the general conditions of carriage of the company in question.


ITINERARIES / TIMETABLES

Itineraries and timetables may be subject to change without notice. La RED STAR FERRIES will not be liable for changes due to force majeure or technical reasons.

MEALS ON BOARD

They are not included in the price. A restaurant/snack bar service is in operation on board.

ACCOMMODATION ON BOARD

Any changes of accommodation should be requested from the reception staff.


BOARDING TIME LIMIT

Passengers already booked with tickets do not have to go directly to the ship, but are required to report to the embarkation agency 3 hours before the departure time. In the event of a delay, the agency has the right to cancel corresponding bookings and accept other waiting passengers. Already booked passengers without a ticket are required to report to the boarding agency by 6 p.m. on the day of departure. The reservation is considered binding only when an advance payment of 20 % of the value of the ticket to be purchased has been made.


CANCELLATIONS AND REFUNDS

In the event of cancellation, the following refunds are provided:

  • Up to 30 days before departure no penalty.
  • From 29 to 7 days before departure 30% of the tariff.
  • From 6 days to the day before departure 50% of the fare.
  • On the day of departure 100% of the tariff.

Refunds are provided only in the event of non-departure of the ship. Refunds in money are made only by the issuing agency. The unused ticket stamped by the embarkation office cannot be used outside the departure date.


OPEN DATE TICKETS

They are valid for one year from the date of issue. It is advisable to always make reservations in advance, especially in July, August and December. Any differences in fares must be settled by passengers at the time of embarkation. Open-date tickets do not constitute boarding rights; if the customer has not made a regular reservation, boarding will only be permitted in the event of availability.

It is always advisable to make reservations in advance, especially in July, August and December (from Brindisi to Vlora) and in September and January (from Vlora to Brindisi).

COMMERCIAL / EXPORT VEHICLES

Passengers must be in possession of a passport/identity card valid for foreign travel.

Passengers with accompanying vehicles must have:
