General Conditions of Carriage - Virtu Ferries

The following are the general conditions of carriage of the company in question.


Transport conditions
- The purchase of the ticket implies the passenger's acceptance of these conditions in all respects.
Price - The ticket price includes the sea leg and fees. The company reserves the right to introduce a fuel surcharge at any time and without prior notice. The ticket price does not include meals.
Validity
- The ticket is only valid for the person/car named above. Open date’ tickets are valid for a period of three months from the date of issue and must be used within this period. After this period, the tickets are no longer valid.
Passengers
- Passengers are advised that it is their responsibility to be fit to travel as weather conditions can change during the crossing. Passengers who have health problems and who have not consulted a doctor before setting out on the voyage must notify the crew prior to departure. The captain of the catamaran may, at his discretion in the interest of the passenger, refuse boarding. It is the passenger's responsibility to check booking details and travel documents carefully and to inform their agent of any inaccuracies. Passengers who require special assistance must notify the company and make a request at the time of booking. Passengers must ensure that they are in possession of valid documents prior to departure. Passengers are requested to sit in the seats indicated by the crew.
Embarkation
- Prior to departure, passengers are requested to ensure that there have been no changes to departure times and dates as stated on the ticket. However, it is recommended to reconfirm both the outward and return booking 24 hours in advance. Passengers must be at the boarding gate at least one hour before departure. Passengers with accompanying cars must arrive at least one and a half hours before departure. Check-in time for passengers and cars is 30 minutes before departure, after which you lose your right to board even if you have a reservation. Check-in closes half an hour before departure. Passengers are responsible for taking care of border formalities. The company is not liable in the event that a passenger does not obtain permission to disembark at the port of destination due to lack of documents or failure to comply with formalities. In such a circumstance, the passenger shall compensate the company for any damages and expenses including the issuance of a return ticket, should this be necessary.
Accompanying vehicles
- All dangerous objects as defined in the International Maritime Dangerous Goods Code (IMDG), as a rule, must be declared to the Company at the time of booking, in accordance with the requirements. It is obligatory to declare the carriage of liquid gas vehicles at the time of ticket purchase. In the absence of such a declaration, the same will be refused. Acceptance of the booking remains subject to the application of codes, legislation, and transport authorisations by the competent authorities at the ports of embarkation and disembarkation. Vehicles are loaded and secured on board in accordance with the Master's instructions. Before leaving the vehicles, it must be ensured that the gear is in first gear (manual gearbox) or in ’P’ (automatic gearbox) and that the handbrake is fully applied. It remains at the passengers’ own risk to leave personal belongings in the vehicles. The Company is not liable for damage to the vehicles and/or the objects contained therein. Passengers are liable to the Company and to third parties for any damage caused to the vessel by the vehicles accompanying them and compensation must be paid before disembarkation. The Master of the vessel may, at his discretion and for reasons of safety, prohibit the boarding of vehicles/loads whose weight/size exceeds the maximum allowed or whose nature/condition could constitute a danger. It is the responsibility of the vehicle driver to ensure that the load contained in/on the vehicle is secured. The driver may not allow transport if the load is not sufficiently secured. The maximum height of vehicles must not exceed 4.35 metres on side lanes and 4.6 metres on centre lanes. The maximum weight, including the load, must not exceed 11 tonnes on the single axle and 14 tonnes on the double axle. The total weight may not exceed 40 tonnes in any case. Weapons, illegal and/or dangerous articles / materials / substances are strictly prohibited from being transported on board in any form or quantity. Drivers must check that the weight of goods loaded onto the vehicle does not exceed the permitted load capacity. Any excess load must be unloaded and the driver of the vehicle must be charged for it. Light vehicles carrying goods not for personal use will be subject to commercial rates.
Baggage
- Passengers are permitted to carry only one item of hand luggage to their seats or assigned places, the dimensions of which must not exceed 37 h x 45 w x 25 l cm and the weight of 5 kg. All other luggage must be deposited by passengers in the reserved place on the ship indicated by the crew. A maximum of 3 pieces of luggage per person is permitted. Each piece of luggage must not exceed measurements of cm. 50 h x cm. 40 p x cm.80 l (the total sum must not exceed a total of 170 linear cm). An excess baggage charge of €20.00 per piece will be applied. The company is not liable for accidental loss or damage to baggage. For security reasons, the Company may destroy any unaccompanied baggage or baggage not collected after disembarkation.
Pets
- All health documents are required. Animals in cages or cars must stay in the garage during the entire journey. The customer must notify the veterinarian prior to arrival in Malta for proper checks on their animals. For any other information please contact Virtu Ferries.
Refunds
- Passengers who cancel their passage in good time are entitled to a refund of their ticket with a deduction determined in the following percentages:
  • 10% for passages cancelled up to 7 days before departure;
  • 50% for passages cancelled 3 days before departure;
  • passages cancelled in less than 3 days are non-refundable;
Passengers who fail to arrive on time for departure or for any reason whatsoever, or who otherwise miss boarding, are not entitled to a refund, even partial, of the amount paid; “open date” return tickets may be refunded within the validity period (3 months) of the tickets with a penalty of 10% Vehicle tickets are non-refundable. Vehicle or vehicle tickets not used on the date booked will be cancelled and non-refundable. Loss of Ticket - In such a case, the passenger will pay a penalty of €10.00 for each reissued ticket. If the lost ticket is found within the validity period (indicated on the ticket), a refund of the €10.00 penalty fee will be made. Each passenger must be in possession of a valid ticket prior to departure.
Responsibilities of the Travel Agent
- It is the Agent's responsibility to communicate to passengers all the information contained in this contract. In the event that the Agent fails to do so, he/she shall be liable for any direct or indirect damage that the client will suffer. The agent is responsible and obliged to inform passengers of any changes in schedules and programmes.
Delays/Cancellations/Changes of course
- the Company reserves the right to change departure and arrival times, postpone, cancel or modify the ship's itinerary without prior notice for both outward and return journeys should it be necessary for safety reasons, or for technical reasons or due to force majeure. In the event of cancellations, the Company will refund the unused portion of the ticket but under no circumstances will it be held liable for any direct, indirect or consequential loss, and it will not accept any claim for reimbursement of any additional expenses.
Boarding Conditions
- We recommend that passengers read the embarkation conditions that can be found at Travel Agents and all Virtu Ferries offices.
Law
- This contract is governed by Maltese law. The Merchant Shipping Act 1973 shall be applied and interpreted as if the vessel were a Maltese vessel.
Jurisdiction
- All disputes in connection with this agreement shall be determined by the Maltese Courts to the exclusion of the jurisdiction of the courts of other countries.
