General terms of service
Below are the terms of service applied by Web Travel s.r.l. for the services offered via the www.sealines.eu website.
RESERVATIONS
Article 1
By sending the booking request by the customer, the terms and conditions of sale of Web Travel s.r.l. (as listed below) and the terms and conditions of sale and carriage of the chosen shipping companies are deemed accepted.
Article 2
Reservations received online, in 80% of cases, are processed by Web Travel s.r.l. within 2 working days. Web Travel s.r.l. accepts and subsequently confirms booking requests only in the event of actual availability confirmed by the shipping companies, otherwise Web Travel s.r.l. is only obliged to return the sums received.
Article 3
Only shipping companies are entitled to vary fares without prior notice until the ticket is finally issued. In the event that, after the ticket has been issued, the company makes changes to the fares or changes to the ship's departure and/or arrival times, notifications of such changes are made directly by the company itself.
Article 4
Web Travel s.r.l. applies the best fares in the best interest of the customer, available at the time the ticket is issued as a result of any offers or promotional fares and shall not be held liable if the application of offers and promotional fares, prevent or limit the possibility of subsequent modification, cancellation and/or refund of the ticket. In the event that the customer does not wish to take advantage of the promotional rates, he/she must contact Web Travel s.r.l directly by telephone or email and expressly communicate this choice.
Article 5
Booking requests are accepted by Web Travel s.r.l. up to the day of departure if the company issues tickets in electronic format. In this case, payment must be made by credit card. The ticket is received by e-mail and, until it is received, the practice is not considered completed. Requests for bookings involving manual ticketing should preferably be received at least 5 working days before the date of departure, and in any case no less than two working days before departure.
Article 6
IWeb Travel s.r.l is in no way responsible for the accuracy and truthfulness of the data provided by the customer during the booking process (all data required by the site form during booking and payment).
Article 7
Reservations made online are considered completed (subject to availability) only after receiving the confirmation e-mail from Web Travel s.r.l.
Article 8
The ticket is issued to each passenger and constitutes a strictly personal ticket that cannot be transferred to another passenger without the Company's consent.
Article 9
Passengers are required to arrive at least three hours before the departure time indicated on their ticket (unless otherwise indicated) in order to complete boarding formalities and check-in.
Article 10
All passengers must carry a valid passport or equivalent identification documents and, where necessary, visa and/or international vaccination certificates.
Article 11
Passengers must also keep their ticket in order to be able to assert their rights at any time. The ticket can be requested by the officers on board during the journey (until disembarkation), and the passenger must present it.
Article 12
Passengers who fail to fulfil the obligations mentioned in ART. 8 - 9 - 10 - 11 shall lose the right to any booked/paid accommodation and their parking space.
Article 13
The Master has the right to deny boarding to a passenger for reasons related to the passenger's health, physical or mental condition, possible state of intoxication, misconduct, including past misconduct, or for any reason he deems strictly necessary.
PAYMENTS
Article 14
The booking request is taken over after the payment has been made and the final issue of the ticket is subject to the availability of the Companies; once the process is completed, the customer receives the final confirmation by e-mail.
Article 15
The exclusive payment method accepted for bookings made online is by credit card through the systems provided by PayPal and Banca Sella. Tickets for some companies can be opted for and then paid for by bank transfer, by contacting Web Travel s.r.l directly by email and/or telephone. For bookings by credit card over the phone, Web Travel s.r.l reserves the right to request the necessary documentation for authorisation of withdrawal.
Article 16
For bookings with payment by bank transfer, the customer is obliged to send Web Travel s.r.l. a copy of the payment by fax or e-mail. In the case of payment by bank transfer, the ticket will be sent to the customer only after it has been credited to the Web Travel s.r.l. bank account.
VARIATIONS AND CANCELLATIONS
Article 17
All requests for changes and/or cancellations of bookings must be sent to Web Travel s.r.l. exclusively by e-mail from the e-mail address used at the time of purchase, enclosing a copy of the booking holder's document. In the event of necessity during the hours or days when Web Travel s.r.l. is closed, the customer may contact the booked shipping company directly and request changes and cancellations from them.
Article 18
In the event of changes to or cancellation of tickets already issued, Web Travel s.r.l. shall refer to the general terms and conditions of carriage of the company in question. The customer may make changes or cancellations to tickets already issued where this is permitted subject to payment of a penalty charge to the Company as well as payment of a penalty charge to Web Travel s.r.l. up to a maximum of €50.00 per change or modification.
Article 19
In the event of non-use of already issued tickets (NON SHOW), the customer is not entitled to a refund.
REFUNDS
Article 20
Refunds requested are subject to ART. 18 and 19. Under no circumstances are booking fees refunded. Refunds can only be made using the same method of payment used (by bank transfer, credited to the Paypal account or debit/credit card used at the time of purchase). The timing of the availability of the sums credited by Web Travel s.r.l depends on the customer's bank.
Article 21
In the event of cancellation or change of tickets, Web Travel s.r.l will refund any sums due to the customer only after having received the reimbursement from the Maritime Company in question. The sums due are net of the penalties applied by the Company and Web Travel, as per ART. 18.
LIABILITY’
Article 22
Web Travel s.r.l. is exclusively an intermediary between the client and the Navigation Company, therefore, it is in no way responsible for malfunctions in the booking system of the Company itself or for any changes made to the booked itinerary.
NON-APPLICABILITY OF THE RIGHT OF WITHDRAWAL
Article 23
The Consumer Code, Art. 7 Law no. 229 of 29 July 2003, published in the Official Gazette no. 235 of 8 October 2005, updated on 10/06/2011 by Legislative Decree no. 79/2011 - Ordinary Supplement No. 162 at Art. 55 “Exclusions” paragraph b, states: “The right of withdrawal provided for in Articles 64 and following, as well as Articles 52 and 53 and paragraph 1 of Article 54 shall not apply: b) to contracts for the provision of services relating to accommodation, transport, catering, leisure, when at the conclusion of the contract the professional undertakes to provide such services on a specific date or within a predetermined period.”
COMPETENT COURT
Article 24
Any disputes are governed by Italian law and are referred to the jurisdiction of the Court of Bari.
