General Conditions of Caronte & Tourist Transport

The following are the general conditions of carriage of the company in question.
Art. 1 Definitions
Passenger means any person carried on the basis of the ticket issued by the Carrier. Carrier and/or Company means Cartour S.r.l. . The Carrier undertakes to transport the passenger and accompanying vehicle(s) under the following conditions that the passenger implicitly declares to know and undertakes to accept in full. The object of this contract is carriage as governed by articles 396 et seq. of the Code of Navigation. The indication of the vessel that will perform the carriage is merely indicative as it is possible to substitute it with another vessel even of another carrier. The carrier is not liable for damage caused by delay or non-execution or inexact execution of the carriage if the event derives from unforeseeable circumstances, force majeure, adverse weather and sea conditions, strikes and technical failures constituting force majeure or other causes not attributable to it. In the event of events that may compromise the safety of the ship and/or passengers, the ship's captain has the right to change the itinerary. The advertised fares and conditions may be subject to change until the ticket is issued. For anything not provided for in these conditions regarding the liability regime in relation to the carriage of passengers and cars, express reference is made to the current regulations of the Code of Navigation. Until disembarkation, passengers are responsible for their luggage and its contents. Crossing times are calculated on the basis of the distance between ports in favourable weather and sea conditions. The Company cannot be held responsible for delays due to port operations.
Art. 2 Validity
The passage ticket is personal, non-transferable, valid only for the carriage indicated on it and must be kept diligently by the passenger and shown, upon request, to any ship's officer or company official. A passenger without a ticket must promptly inform the captain and/or steward, under penalty of paying double the passage fare to the port of destination.
Art. 3Price of passage
The price indicated on the ticket is that of the carrier's tariff, in force on the date of its issue, and does not include the provision of food on board, which remains the responsibility of the passenger. Furthermore, the passenger shall bear the costs, taxes and fees for embarking and disembarking, stamps, etc. . The carrier has the right to change the fares of available services at any time. Tickets purchased directly from the on-board ticket offices may require payment of a surcharge for use of the boarding area ticket office. ATTENTION - Invoices for tickets valid for the Messina-Salerno line may only be requested at the time of booking or, in any case, no later than the same day of ticket purchase.
Art. 4 Special and Promotional Rates and Conventions
All special and/or promotional fares are available subject to availability of dedicated seats and are automatically proposed by the booking system. The application of Special and/or Promotional fares will depend on the date of booking and/or departure, the number of passengers, the accommodation chosen, the booking channel used and is subject to the availability of dedicated seats at the time of booking. Bookings purchased with Special or Promotional fares can only be changed if they include the Flexibility Option and cannot be cancelled or refunded. The Flexibility Option will not exempt the customer from paying any fare differences resulting from the requested change. Passengers in possession of a ticket purchased with a convention, must compulsorily show a copy of a document proving their membership in the convention organisation/association (the number of which will be shown on the ticket purchased), together with their identity document, when checking in at the ticket office. The type of documentation required for individual conventions can be found on the Company's official website in the Conventions section. The member must obligatorily be present in the passenger list of the contracted booking. Failure to produce the necessary documentation and/or non-compliance with the General Conditions of Carriage will result in the forfeiture of the booking and the consequent right to boarding, and therefore the passenger must purchase a new ticket at the fares in force at the time of purchase. The passenger may request the Company to refund the unused ticket, which will be subject to a penalty of 25%. PLEASE NOTE: Promotions cannot be combined with each other nor can they be applied to a contracted ticket.
Art. 5 Fees and surcharges
The fares in force are net of surcharges due to possible increases in fuel costs, which are subject to change until the ticket is issued. Booking fees of up to € 5.00 per passenger (per file and per route) are applied to the ticket price. The ticket price will also include the application of Fixed Rights for each vehicle entered and the Fuel Surcharge for each vehicle and each passenger booked. Tickets purchased directly from the ticket offices on board may include the payment of a surcharge for use of the boarding area ticket office.
Art. 6 Non-departure
The embarkation time, unless otherwise modified in writing, is two hours (2h) before the scheduled departure time of the ship, for passengers with accompanying vehicles, and one hour (1h) before for passengers without accompanying vehicles. Failure to observe the aforementioned timetable will result in the forfeiture of the reservation and the right to a refund, even partial, of the price paid. Passengers who do not present themselves in accordance with the above timetable for embarkation or who, in any case, do not embark on the ship scheduled and indicated on the ticket, are not entitled to a refund, even partial, of the price paid.
Art. 7 How to book
It is possible to book your journey for the Autostrade d'Amare routes exclusively in the following ways: By telephone, by calling the toll-free number 800.62.74.14 (090.36.46.01 from abroad) On Line, by connecting to the site http://www.carontetourist.it (except for commercial vehicles) Through an authorised travel agency (except for commercial vehicles) At the ticket office, by going to the ticket offices at the ports of embarkation (the service will incur a surcharge), or by going to the ticket office in the square in front of Rada San Francesco (located in Messina, viale della Libertà) Reservations for commercial vehicles can only be made through the Call Centre, by calling the toll-free number 800.62.74.14 (090.36.46.01 from abroad). Prepaid reservations, made online or via call centre, are valid exclusively for the boarding of: Passengers Passengers Cars Motorcycles Caravans Minibuses Buses Passengers holding a prepaid reservation who present themselves at boarding with a vehicle that does not correspond to one of the above-mentioned types and/or to the one booked, will have to purchase a new ticket for the actual type of vehicle to be boarded, and will in fact lose the right to reimbursement of the fare of the vehicle previously booked and shown on the ticket. This procedure will not, in any case, compromise the right to use the accommodation already purchased and shown on the ticket. It is up to the customer to ensure that the details of the booking purchased correspond to his or her needs, otherwise the carrier will not be liable for any errors. WARNING: In the event that, at the end of an online booking, the customer does not receive by e-mail (as provided for by the online booking system) the ticket he/she has just purchased, it is necessary to immediately contact the Customer Office, toll free number 800.62.74.14, to make sure that his/her booking and payment have been duly made. ATTENTION - Invoices for tickets valid for the Messina-Salerno route can only be requested at the time of booking or, in any case, no later than the same day on which the ticket was purchased.
Art. 7.1 Flexibility Option
The Flexibility Option allows you to make a maximum of 2 (two) changes to your booking without incurring any penalty, but it is not valid for booking cancellation requests, nor does it exempt you from paying any fare differences resulting from the requested change. Requests for changes to bookings covered by the Flexibility Option may be sent up to 8 working hours (see Art. 8.2) before the departure date shown on the ticket. The Flexibility Option is not refundable individually, but only against cancellation of the entire reservation. The Flexibility Option is the only available ancillary service that allows you to make a change to a reservation purchased with Special or Promotional fares.
Art. 7.2 Tariffs
The fares available on the booking system are divided into Special and/or Promotional Fares (see Article 4 of this document) Discounted Fares and Ordinary Fares. The fare entities are subdivided as follows: Special and/or Promotional Fares Early Price - Promo Car - Promo Motorcycle Discounted Fares Fare A - Fare B Ordinary Fares Fare C - Fare D - Fare F - Fare H - Fare K - Fare Z The fares will be applied automatically by the system, which will always propose the lowest fare available at the time of booking. The fare amount is specified on the ticket for each individual category.
Art. 7.3 Reservations
Bookings shall be identified by an identification code (booking code) and may involve the issue of one ticket (in the case of one-way bookings) or two tickets (in the case of return bookings). Return tickets may benefit from concessionary and discounted fares up to a maximum of 20% compared to the ordinary fare of the same category. In fact, all fare entities provide for an outward fare and a return fare, discounted in relation to the former up to a maximum of 20% per category (car fare excluded). The above-mentioned principle does not necessarily provide that the total amount of the return ticket must be lower than the amount of the outward ticket, since this eventuality is provided for only if the tariff entity and the composition of both tickets are the same. Cancellation of the outward ticket will result in forfeiture of the discount applied to the return ticket. ATTENTION: Any change to a booking will entail a change to all the tickets in the booking (which will be assigned a new numbering). This operation may result in a fare update for all tickets in the booking. If, for example, a change is requested for an outbound ticket, the possible fare update may also affect the return ticket, even if it is not changed, since changes are made to the booking and not to individual tickets. The fare update resulting from a request for a change shall entail the application of the fares in force for the requested journey at the time of the operation. Differences in fares resulting from a variation may be refunded, if in favour of the customer, or paid by the passenger in the event of an increase, as provided for in Article 8 of these General Conditions.
Art.8 Reservation Change/Cancellation
Art. 8.1 Application procedure
Reservations made online and by telephone cannot be changed/cancelled directly at the ticket offices at the ports of embarkation and/or on board the company ships. It is possible to make a change to one's booking or request its cancellation exclusively by following the following procedures: by e-mail by writing to the following e-mail addresses: servizioclienti@carontetourist.it (only for bookings made by private customers) infoagenzie@carontetourist.it (address dedicated exclusively to travel agencies) by fax by sending a fax to the following number: 090 53.416 Requests for changes/cancellations of bookings made through travel agencies must be sent exclusively to the reference travel agency. All variation requests must include Booking code of the reservation to be changed (Booking code) subject of the change (e.g. change of date, change of accommodation etc...) telephone number (preferably mobile) of the applicant. All cancellation requests must include: Booking code of the reservation to be cancelled (Booking code) telephone number (preferably mobile) of the applicant Bank details complete with Iban code and account holder exclusively for reservations purchased by debit card, cash or bank transfer. ATTENTION: It is not possible to send variation/cancellation requests from the Form* on the www.carontetourist.it website. All requests sent via the Form will be considered null and void. It should also be noted that the reservation holder cannot be changed or deleted unless the entire reservation is cancelled. *message box on the site dedicated exclusively to informative communications
Art. 8.2 Timing of requests - Variations
Variation requests must be received by the Company no later than 24 working hours prior to the departure date of the booked vessel (8 hours for bookings covered by the Flexibility Option) . Variation requests cannot be sent on Saturdays, Sundays and public holidays and must be received by the Company during the opening hours of the relevant offices (Monday to Friday from 09:00 am to 5:00 pm). Notifications that do not respect the aforementioned timeframe will be registered with the date of the first following working day (e.g. a request sent at 22:45 on Friday will be registered with the date of the following Monday), in which case, however, the penalties will be applied in relation to the actual date the request was sent, provided that the request is not received within 24 hours of the departure date shown on the ticket. The following penalties will apply in the event of a change to a booking, which will be calculated on the full price of the original booking and will vary in amount depending on: the date of issue of the booking, the departure date of the ship shown on the ticket and the date the change request is sent. The following penalties apply in the event of a change to a reservation: 0% - in the case of a request sent within 24 hours of the issue of the reservation, excluding the 24 hours that coincide with the departure date shown on the ticket. 10% - in the event of a request sent prior to 19 (nineteen) days prior to the departure date shown on the ticket 15% - in the event of a request sent between 19 (nineteen) and 4 (four) days prior to the departure date shown on the ticket 25% - in the event of a request sent within a period of time between 19 (nineteen) and 4 (four) days prior to the departure date shown on the ticket 25% - in the event of a request sent within a period of time between 19 (nineteen) and 4 (four) days prior to the departure date shown on the ticket in the event of a request sent between 3 (three) days and 1 (one) day prior to the departure date shown on the ticket 100% - in the event of a request sent within 24 hours coinciding with the departure date shown on the ticket The change of a reservation may include in addition to a penalty, the possible application of different fares from those paid at the time of purchase. The differences that will accrue from any change in your booking may be paid, if charged to the customer, in the following ways: telephone payment by credit card payment by bank transfer (only if the change is made at least 15 days before the new departure date). PLEASE NOTE: Bookings purchased at promotional rates with limited availability may not be subject to either changes (only allowed if the Flexibility Option is present) or cancellations.
Art. 8.3 Timing of Requests - Cancellations
The request for cancellation of a booking must be received by the Company no later than 24 working hours prior to the departure date of the booked vessel. The request for cancellation of a booking cannot be sent on Saturdays, Sundays and public holidays and must be received by the Company during the opening hours of the relevant offices (Monday to Friday from 09:00 am to 5:00 pm). Notifications that do not respect the aforementioned timeframe will be registered with the date of the first following working day (e.g. a request sent at 22:45 on Friday will be registered with the date of the following Monday), in which case, however, the penalties will be applied in relation to the actual date the request was sent, provided that the request is not received within 24 hours coinciding with the departure date shown on the ticket. Requests for reimbursement that are sent after the departure of the booked vessel will not be taken into account, as no compensation will be due. Cancellation of a reservation will entail the application of the following penalties, which will be calculated on the full price of the reservation and will vary in amount depending on: the date of issue of the reservation, the date of departure of the ship shown on the ticket and the date the cancellation request is sent. The following penalties apply in the event of a reservation cancellation: 0% - in the case of a request sent within 24 hours of the issue of the reservation, excluding the 24 hours coinciding with the departure date shown on the ticket. 75% - in the event of a request sent between 47h and 24h before the departure date stated on the ticket (provided that the request is not sent within 24h of the departure date stated on the ticket) 100% - in the event of a request sent within 24h of the departure date stated on the ticket The penalties for cancellations of bookings previously changed, will be established in relation to the date of the original booking. N.B. Please pay particular attention to the timing of sending your cancellation requests. Should a cancellation request, for example, be sent on a public holiday, it will be up to the customer to ensure that it can be read before 24 hours coinciding with the ship's departure date. Otherwise, it will not be possible to proceed with the cancellation of the booking and, consequently, no refund will be due.
Art. 8.4 Refunds
Refunds of reservations whose cancellation or modification has been correctly requested, in accordance with Articles 8.2 and 8.3 of this document, will be made in the following ways * : Reversal/credit to the credit card used for the payment Bank transfer (exclusively for bookings purchased by debit card, cash or bank transfer) Bank cheque sent by registered mail with return receipt (exclusively for bookings purchased by debit card, cash or bank transfer) Refunds will be made within 90 working days from the date of cancellation. * The type of operation will be determined by the office in charge, depending on the payment method used to purchase the reservation to be refunded. PLEASE NOTE: Reservations purchased at promotional rates with limited availability may not be subject to either variations (only allowed if the Flexibility Option is present) or cancellations.
Art. 9 Early departure, late departure or arrival, cancellation of departure or change of itinerary
Prior to departure, the passenger is obliged to check that there are no changes to the vessel and time indicated on the ticket. The company has the right to cancel the announced departure, to add or omit stopovers, to have the voyage start from a port other than the one established, to change the itinerary, to assign the ship to another line, to bring forward or delay the departure date or time. In the event that departure is delayed for more than 12 hours (twelve) with respect to the scheduled departure time, the passenger has the right to reimbursement of the price of the unused passage. The captain has full authority to proceed without a pilot, to tow or assist other ships under any circumstances, to deviate from the ordinary route in any direction for any distance and for any purpose, to sail both before and after departure to any port or ports that may or may not be on the ship's itinerary, even if in the opposite direction or beyond the usual route, either by going backwards or forwards in any order and for any purpose, one or more times, to transfer the passenger and the vehicle to any other ship or means of transport, whether or not belonging to the company, bound for the port of destination. The time of arrival, if specified in the ticket, or otherwise communicated by the company or its agents, is purely indicative and the carrier is not responsible for any delay.
Art. 10 Vehicle embarkation and disembarkation
Vehicles shall be called for embarkation in the order ordered by the ship's captain and/or his aides and agents. Vehicle boarding operations, including their accommodation in the assigned place on board, disembarkation operations, as well as the possible transfer of the vehicle from the parking place to the ship and/or the possible transfer of the vehicle from the ship to the parking place, are always carried out at the sole care, risk and responsibility of the passenger. The passenger is also exclusively responsible for any damage to his or her vehicle, the goods and luggage contained therein, his or her own person, as well as the persons in the vehicle. The passenger is also exclusively liable for any damage caused to third parties, their vehicles, goods and luggage. The vehicle, including any trailer and/or caravan, with what it contains, is accepted by the carrier as a single load unit without declaration of value: therefore, the carrier's liability for loss of and/or damage to the vehicle cannot exceed the limit set out in Art. 423 of the Italian Navigation Code. In the event of an accident on board, the passenger is in any case required to immediately report the incident to the captain who will, should the need arise, draw up a report to initiate the appropriate insurance procedures. Otherwise, and therefore in the absence of a report from the captain on duty, the company will not accept any complaint regarding accidents occurring on board its vessels and/or in the areas under its jurisdiction.
Art. 11 Rules to be observed
The passenger shall comply with the requirements of Italian and foreign laws, as well as the company's regulations and the provisions given by the ship's captain. Moreover, the passenger is directly liable to the company for all fines, harassment and expenses to which, through his fault, the company is subjected by Port, Customs, Health Authorities and/or any other Authority of any country. It is also agreed that minors must be kept under the supervision of their parents or other designated persons and may not circulate on the vessel unaccompanied. In the event of an emergency, passengers must place themselves at the disposal of the captain and officers and must carry out the orders and prescriptions received in a disciplined manner.
Art. 12 Passenger health conditions
The captain has the right to refuse passage to anyone who is in such a physical or mental condition (including pregnant women) that they are unable to undertake the voyage or to anyone who is dangerous due to the use of narcotics, hallucinogens, alcohol, illness or infirmity. In such cases, the passenger shall not be entitled to reimbursement or compensation for damages and shall be liable for damages caused to the ship, all of its fittings and equipment, to third parties, and to third parties' property. Acceptance of the passenger on board by the company shall not be considered as a waiver by the company of its reservations regarding the passenger's condition, whether known or unknown to the company, at the time of embarkation and/or departure of the vessel.
Art. 13 Explosives, Flammables and Hazardous Materials
It is strictly forbidden for a passenger to include in his or her baggage or belongings placed on board vehicles, industrial residues or explosive and/or flammable substances or otherwise dangerous to the safety of the ship, the cargo or the safety of other passengers or crew members. In the event of violation of this prohibition, the master is authorised to seize or destroy such substances, without the passenger being able to claim any compensation. In addition, the passenger shall be liable for the consequences of violating this prohibition.
Art. 14 Weapons
Upon boarding, passengers are obliged to hand over all firearms and/or firearms in their possession to the captain for safekeeping. In case of non-compliance, offenders are liable to seizure of the weapons and referral to the competent judicial authority.
Art. 15 Animals
The carriage of small pets (cats, dogs, etc.) accompanying passengers is permitted as long as they have a health certificate and the corresponding ticket has been purchased. In accordance with health and hygiene regulations, pets, when accepted by the company, must travel in rooms reserved for them, as passengers are strictly forbidden to keep them in the cabin and on company premises. Passengers are liable for any damage caused to property or third parties by their pets. The carrier declines any liability for any seizure or suppression of animals by the Sanitary Authorities of the port of disembarkation/embarkation, as well as for injury, loss or death of animals occurring during transport, embarkation or disembarkation.
Art. 16 Accommodation
The passenger must occupy the seat indicated on the ticket or, failing that, the seat assigned to him/her by the captain or steward. The company has the right to assign the passenger a seat other than the one indicated on the ticket: if the seat assigned is of a higher type, the difference in fare shall not be applied; if the new seat is of a lower type, the difference paid in excess shall be reimbursed to the passenger in full settlement of any claims.
Art. 17 Applicable Law and Jurisdiction
The contract of carriage shall be governed by and construed in accordance with Italian law. For any dispute concerning the interpretation and/or execution of the contract of carriage, the Court of Messina shall have exclusive jurisdiction.
